<br />WHEREAS, after deliberations, the staff members of the jurisdictions have selected the <br />non-profit corporation Trust for Public Land as consultant for this Project (the <br />"Consultant"); and <br /> <br />WHEREAS, the City of Concord, Cabarrus County, City of Kannapolis, the Town of <br />Harrisburg, the Town of Mount Pleasant and the Town of Midland have agreed to <br />contribute funding for compensation of the Consultant. <br /> <br />NOW, THEREFORE, in consideration of the above recitals and the terms below, the <br />parties hereto do mutually agree as follows: <br /> <br />SECTION 1: The County of Cabarrus will act as lead agency in receiving the <br />technical advice and assistance from the Consultant in connection with efforts to finance <br />the acquisition of land for recreation, parks, conservation, and open space and shall be <br />responsible for the compensation of the Consultant, as specified in the Agreement for <br />Professional Services between the County of Cabarrus and the Trust for Public Land, <br />(the "Consultant Contract"), which is incorporated by reference as a part of this <br />Agreement. <br /> <br />SECTION 2: The project shall be performed in accordance with the Consultant <br />Contract and shall begin immediately, and will be generally completed within two years. <br /> <br />SECTION 3: The indicated jurisdictions will advance the following sums to the <br />County of Cabarrus for the preparation of the Research/Public Operations and <br />Recommendation Study for LCB: the City of Kannapolis and City of Concord; $5,000 <br />each; the Town of Harrisburg, Town of Mount Pleasant, and Town of Midland; $1,500 <br />each. This total of $14,500 shall be added to the $5,000 budgeted by the lead agency, <br />Cabarrus County. <br /> <br />SECTION 4: If during the progress of the project additional tasks are necessary, <br />or are desired by the parties, each party shall contribute its prorata share of such <br />additional project cost, in the same proportion as the advancements described in <br />Section 3. <br /> <br />SECTION 5: Each party will furnish staff, and appropriate documentation, as <br />necessary, to assist the consultant. <br /> <br />IN WITNESS WHEREOF, the parties have executed this Memorandum on the <br />dates indicated below. <br /> <br />2 <br />\=.-~ <br />
