CABARRUS COUNTY
BOARD OF COMMISSIONERS
AGENDA ITEM REQUEST

Meeting Date 4/18/05

Agenda Item #

E-l

SUBJECT:
Wellington Chase Subdivision C05-06(S) -Appeal of P&Z's February 17th, 2005 decision
to deny (this item was tabled on March 21 until this meeting)

BRIEF SUMMARY:
Wellington Chase is a 292 lot subdivision located near the intersection of Odell School Rd
and Hwy 73. The property is zoned LOR and the applicants have chosen to apply the
customized development option. The proposed density is 1.69 units per acre. The
Cabarrus County Planning and Zoning Board denied approval of the development on
February 17th, 2005. Their denial was based on traffic concems and lack of school
capacity in the area. The developer, Parker Orleans Homebuilders, has agreed to
contribute $4,032.00 per lot to advance school adequacy.

REQUESTED ACTION: (Suggested motion if the Board approves the agenda item as presented)
Consider the appeal submitted by Parker Orleans Homebuilders and take appropriate
action.

Attachments ~ Yes D No Expected Length of Presentation 10 minutes

Submitted By: Nicole Storey, AICP - Senior Planner Date: 3/16/05

Name / Job Title

Budget Amendment Required: D Yes ~ No
Budget Amendment Attached and Reviewed by Budget Officer: D Yes ~ No

County Manager's Recommendations/Comments:

If the Board chooses to deny the appeal on the basis of school adequacy, the inclusion of
an explanation to the abrupt halt to the 7 year practice of allowing the advancement of
school adequacy is strongly suggested. Such an inclusion may help buttress the Board's
position if it should find itself defending its actions in court.

Manager's Signature

Action Taken:
Approved []
Denied [ ]

Deferred []
Other [ ]

E -I
