Council shall meet periodically to review and discuss land uses development trends, transportation operations and public investment requirements. A separate Memorandum of Understanding will govern the operations of the Council of Planning. S. Future Actions Affecting Land Uses Along the Corridor: All parties recognize that future governmental entities may not be contractually bound by the adoption of this Memorandum of Understanding. In recognition of this limitation, the Parties commit to review the status ofland use and public investment decisions along the Corridor periodically. Furthermore, the Parties, in good faith, commit to: 1) review the recommendations of the Council of Planning; and 2) meet periodically with other Parties regarding emerging issues along the Corridor. The intent ofthis commitment is to promote periodic discussions of municipal and/or county goals, plans and strategies for maintaining effective development patterns, public investment and transportation flow along NC 73. 6. Council of Governments: The Centralina Council of Governments commits to participate in the NC 73 Council of Planning and to support and encourage the other Parties to abide by the commitments contained in this MOU. 7. MPOs and RPO: The Cabarrus-Rowan Metropolitan Planning Organization, the Mecklenburg-Union Metropolitan Planning Organization, and the Lake Norman Rural Transportation Planning Organization commit to considering Transportation Plan amendments as necessary to incorporate NC 73 elements; supporting the NC 73 Corridor Plan through consideration of inclusion of the Corridor on the MPO's Transportation Improvement Program; and working for inclusion ofthe NC 73 Corridor on the State Transportation Improvement Program as appropriate. 8. NCDOT: NCDOT recognizes the importance of and appreciates the long range land use planning envisioned by the Plan. All Parties agree that NCDOT's only responsibility under this MOU is to share information relating to transportation planning within the area. It is understood by all Parties that NCDOT does not have the authority to approve or dictate land use plans. To that end, NCDOT will consider the Plan and incorporate elements of it, as appropriate, in future long range transportation plans. NCDOT will consider individual projects along the NC 73 Corridor for inclusion in the State Transportation Improvement Program as deemed appropriate by NCDOT and in accordance with all state and federal laws and regulations. IN WITNESS WHEREOF, the Parties, through their duly authorized representatives, have executed this Memorandum of Understanding and the counties and municipalities have attached maps relating to their respective jurisdictions, effective this day of ,2005.
