<br />Council shall meet periodically to review and discuss land uses development trends, <br />transportation operations and public investment requirements. A separate Memorandum <br />of Understanding will govern the operations of the Council of Planning. <br /> <br />S. Future Actions Affecting Land Uses Along the Corridor: All parties recognize that <br />future governmental entities may not be contractually bound by the adoption of this <br />Memorandum of Understanding. In recognition of this limitation, the Parties commit to <br />review the status ofland use and public investment decisions along the Corridor <br />periodically. Furthermore, the Parties, in good faith, commit to: 1) review the <br />recommendations of the Council of Planning; and 2) meet periodically with other Parties <br />regarding emerging issues along the Corridor. The intent ofthis commitment is to <br />promote periodic discussions of municipal and/or county goals, plans and strategies for <br />maintaining effective development patterns, public investment and transportation flow <br />along NC 73. <br /> <br />6. Council of Governments: The Centralina Council of Governments commits to <br />participate in the NC 73 Council of Planning and to support and encourage the other <br />Parties to abide by the commitments contained in this MOU. <br /> <br />7. MPOs and RPO: The Cabarrus-Rowan Metropolitan Planning Organization, the <br />Mecklenburg-Union Metropolitan Planning Organization, and the Lake Norman Rural <br />Transportation Planning Organization commit to considering Transportation Plan <br />amendments as necessary to incorporate NC 73 elements; supporting the NC 73 Corridor <br />Plan through consideration of inclusion of the Corridor on the MPO's Transportation <br />Improvement Program; and working for inclusion ofthe NC 73 Corridor on the State <br />Transportation Improvement Program as appropriate. <br /> <br />8. NCDOT: NCDOT recognizes the importance of and appreciates the long range land <br />use planning envisioned by the Plan. All Parties agree that NCDOT's only responsibility <br />under this MOU is to share information relating to transportation planning within the <br />area. It is understood by all Parties that NCDOT does not have the authority to approve or <br />dictate land use plans. To that end, NCDOT will consider the Plan and incorporate <br />elements of it, as appropriate, in future long range transportation plans. NCDOT will <br />consider individual projects along the NC 73 Corridor for inclusion in the State <br />Transportation Improvement Program as deemed appropriate by NCDOT and in <br />accordance with all state and federal laws and regulations. <br /> <br />IN WITNESS WHEREOF, the Parties, through their duly authorized <br />representatives, have executed this Memorandum of Understanding and the counties and <br />municipalities have attached maps relating to their respective jurisdictions, effective this <br />day of ,2005. <br /> <br />COUNTY OF CABARRUS <br />By <br /> <br />Ne 73 MOU -AG DRAFT <br /> <br />Page3 of 5 <br />1="-3 <br /> <br />February 2005 <br />
