<br />4. Department EmploymentlDirector of Services - The Department shall be under the <br />control and supervision of the Director of Facilities (the "Director"). The Director will <br />report directly to the Superintendent of the Cabarrus Board ("Cabarrus Superintendent") <br />until such time when (and if) the County consolidates its maintenance and repair services <br />into the Department. If County consolidation occurs, the Boards and the County will <br />reevaluate the reporting requirements of the Director at that time. <br /> <br />The Director will provide written reports to the Cabarrus Superintendent at least once per <br />quarter. In the event the Director resigns, retires or is terminated, the Superintendents of the <br />Boards will appoint a new Director who is mutually satisfactory to the County and the <br />Boards. <br /> <br />The Cabarrus Board will provide the Director with an enumeration of his <br />responsibilities, including without limitation, monitoring all services set forth as well as <br />services provided under any contract with third parties. <br /> <br />5. Annual Maintenance and Repair Plan - The Director is charged with the responsibility of <br />conducting a survey of the School Facilities and shall use this survey in preparing an annual <br />Maintenance and Repair Plan (the "Plan") which covers the School Facilities and all responsibilities set <br />forth herein, as well as the status of completing those responsibilities as of the date of the Plan. The <br />Plan will contain the proposed Services schedule and budget for the upcoming fiscal year and shall <br />prioritize all School Facilities repair projects. The Director will present the Plan to the Superintendents <br />for the Boards (the "Superintendents") as part of the "Budget Approval Process" each year of this <br />agreement. The Plan must receive approval by the Superintendents. The approved Plan will then be <br />presented as a component of the school budget request to the County Manager and the County Board <br />of Commissioners as part of their "Budget Approval Process" each year. <br /> <br />6. Funding - Implementation of this Agreement is contingent upon the County Board of <br />Commissioners allocating to each Board respectively, for each fiscal year this Agreement is in effect, a <br />minimum of $1,272.00 per pupil in each Board's school system, based upon the per pupil ADM <br />Numbers allocated to each Board. During each year this Agreement is in effect, the Boards will each <br />contribute to the Department funds for the Services as more fully set forth herein (the "Fund"). <br />(However, in the event the County merges its maintenance and repair staff into the Department, the <br />County and the Boards will, at that time, reevaluate the basis for allocation of contributions among the <br />Parties). The Fund will be used exclusively by the Department to provide the Services, including <br />Department payroll. The Fund will receive (subject to certain conditions more fully set forth below), <br />each fiscal year, allocations from each Board based upon a per pupil amount agreed upon by the <br />Parties multiplied by the number of pupils in each Board's school system. For purposes of determining, <br />the number of pupils in each Board's school system, the Parties agree that the state certified proj ected <br />attendance numbers issued each year in March'will be used (the "ADM Number(s)"). Therefore, each <br />fiscal year, each Board shall pay to the Fund that amount equal to the per pupil amount agreed to by <br />the Boards each fiscal year, multiplied by the ADM Number of pupils in their respective school <br />systems. Kannapolis' payment contribution to the Fund shall include the same per pupil amount for <br />each pupil who resides in Rowan County. <br /> <br />F-I <br />3 <br />
