<br />the program is not completed. The first two reports shall explain what work has been completed <br />and any results as well as a time schedule for completion of the rest of the program. The final <br />report shall document that the replacement program has been completed. The site shall be <br />regularly inspected by the enforcement branch of the Cabarrus County Planning and Zoning <br />Department to assure activity and compliance. Any noncompliance shall be treated as a zoning <br />violation and be subject to enforcement as described in Chapter Twelve of this Ordinance. <br /> <br />5. A minimum setback from the stream buffers for all buildings and structure shall be at least 20 <br />feet. <br /> <br />6. Land within a stream buffer shall not be used to meet minimum lot size reauirements. exceot <br />where lots are areater than one acre in area, in which case at least 50 oercent of the lot shall <br />remain outside the stream buffer. <br /> <br />2. Purpose. <br /> <br />The purpose of this Section is to provide sufficient land area for the provision of <br />manufactured housing in order to implement NCGS ~ 160A-383.1 and to provide affordable <br />housing opportunities for low and moderate income persons. A manufactured home is defined <br />as structure, used or intended to be used as a Dwelling Unit, transportable In one or more <br />sections, which in the traveling mode is eight body feet or more in width, or 40 body feet or <br />more in length, or, when erected on site, is 320 or more square feet; and which is built on a <br />permanent chassis and designed to be used as a dwelling, with or without permanent <br />foundation when connected to the required utilities, including the plumbing, heating, air <br />conditioning and electricai systems contained therein. "Manufactured home" includes any <br />structure that meets all of the requirements of this subsection except the size requirements and <br />with respect to which the manufacturer voluntarily files a certification required by the Secretary <br />of the United States Department of Housing and Urban Development and complies with the <br />standards established under the National Manufactured Housing Construction and Safety <br />Standards Act of 1974, 42 U.S.C. ~5401, et seq. (Source: The Uniform Standards Code for <br />Manufactured Homes Act," NCGS ~ 143-145). For purposes of this Part, a "manufactured <br />home" does not include a structure which otherwise complies with this subsection, but which <br />was built prior to June 15, 1976, which units shall be classified as "mobile homes." <br /> <br />, <br /> <br />Section 4-44. Modular Homes Exempted. <br /> <br />Manufactured (or Modular) Housing Constructed to meet the N.C. State Building Code <br />shall be exempt from the restrictions of this Part VII and shall be permitted in any Single-family <br />detached dwelling zoning district subject to any other provisions of this Ordinaflce. <br /> <br />Section 4-45.
