<br />1. LEASE\> SPACE. Arts Council will lease all of the offices located in the <br />Courthouse located on tJte first floor except for the "Museum Room" which is currently <br />leased to Historic Cabar,us, Inc. Arts Council will also have shared use of a conference <br />room and the kitchen in!the Courthouse. Hereafter, the office space and shared use of the <br />conference room and kilchen shall be collectively referred to as the "Leased Premises". <br />The County will install ~lectrical and telephone connections in the Leased Premises for <br />the use of Arts Counci1.! <br /> <br />2. TERM QF LEASE. To have and to hold for a term of 5 years <br />commencing on ',2005, and ending on ,2010, unless sooner <br />terminated upon written!mutual consent of both parties. The term of the Lease shall be <br />automatically extended for five additional years, unless either party gives notice ninety <br />(90) days prior to the en~ of the current term that it wishes to terminate the Lease. . As a <br />condition to the arts C01.incil having the additional five year term, the Arts Council shall, <br />during the initial term, njlake improvements to the Leased Premises and auditorium of the <br />Courthouse, including but not limited to the P A system, light system and curtains, said <br />improvements to be in aivalue of not less than $75,000.00. Any improvements made by <br />the Arts Council shall b~ carried out in accordance with the terms of Paragraph 7 below. <br /> <br />3. LEASE A YMENTS. Arts Council shall pay the County annual rent of <br />$1.OO(ONE DOLLAR) or the right to occupy the Leased Premises. Lease payments <br />shall be due and payabl~ the first day of July each year of the Lease term. <br /> <br />4. COUNTY RESPONSIBILITIES. <br /> <br />a) Mainten,nce: The County will maintain the exterior of the Courthouse <br />building and the grounds, which responsibilities will include, without limitation, <br />maintenance an repair of the Courthouse structure, roof, HV AC system <br />landscaping and ighting of the Courthouse grounds, and maintaining the <br />currently availabe parking facilities on the Courthouse grounds. All maintenance <br />and repairs shall e performed in a workmanlike manner, normal wear and tear <br />excepted. In add tion, the County agrees to maintain the interior of the <br />, <br />Courthouse building in a condition as much like its original condition as possible; <br />provided however, that central heating, air conditioning, electrical fixtures and <br />appliances may b~ utilized in such ways that are as non intrusive as possible on <br />the Courthouse i~. erior and in keeping with the original fixtures. The County <br />may make such a' ditional improvements as shall contribute to the beauty of the <br />Courthouse as clse as possible to what is believed to be its original existence. <br />All such improvefnents shall be done under consultation with a competent <br />architect and accqrding to a general plan of organized historic renovation and <br />restoration.
