<br />b) Insurance: The County will keep in force liability insurance in such <br />amounts and against such hazards as may be necessary or desirable and will <br />insure the Leased Premises against fire and windstorm for the use and benefit of <br />Arts Council and/or the County, as its interests may appear. If the building upon <br />the Demised Premises shall be damaged by fire or other casualty, and such <br />damages are of a minor nature, the same shall be repaired by Cabarrus County <br />directly, or from the proceeds of insurance coverage, as quickly as is reasonable <br />possible. If the Courthouse is damaged to such an extent as to render the same <br />unfit for use or occupancy, this Lease shall terminate and the proceeds of <br />insurance coverage shall be paid to the County, and Arts Council shall be relieved <br />from further liability under the Lease. <br /> <br />5. ARTS COUNCIL RESPONSIBILITIES. <br /> <br />a) Maintenance. Except for the County's obligations to maintain the Leased <br />Premises as set forth above in paragraph 4(a), Arts Council agrees to maintain the <br />Leased Premises in good order, normal wear and tear excepted. Arts Council will <br />properly secure the Leased Premises and will promptly notify the County of any <br />damage or repairs needed in the Leased Premises. Arts Council will not commit <br />any waste of the Premises and will pay for all damage to buildings or equipment <br />promptly. ' <br /> <br />b) Insurance. Arts Council shall be responsible for providing insurance <br />against fire, theft, water or other damage for its personal property, including any <br />fixtures installed on the Leased Premises. Arts Council shall also be responsible <br />for providing insurance against, fire, theft, water or other damage for the personal <br />property of its employees, agents, invitees and guests, including but not limited to <br />all exhibits owned by third parties that the Arts Council displays in the Leased <br />Premises. <br /> <br />c) Utilities. Cabarrus County shall De responsible for the payment of all bills <br />for water, heating and electrical current. The occupants of the Courthouse shall <br />be responsible for the payment of their own respective telephone bills. <br /> <br />d) Deleted intentionallv. <br /> <br />e) Auditorium Use. Arts Council shall have the right to use the auditorium, <br />subject to the rights of Historic Cabarrus, Inc., as set forth in that certain Tenant <br />Use Agreement, as the same may be amended, entered into by and between <br />Cabarrus County, The Cabarrus Arts Council, Inc., and Historic Cabarrus, Inc. <br /> <br /> <br />1) DisDlavs In Public Areas. Prior to installing any display or showcase in a <br />public area, the location and materials used for the display shall first be approved <br />by Cabarrus County. Public areas shall include all hallways, landings, foyers, <br />entrances and the auditorium. It is expressly agreed that nothing contained herein <br />shall grant Cabarrus County the right or obligation to approve the content of any <br /> <br />E-Co <br />
