<br />display or artwotk chosen by Arts Council and the content of all displays and <br />artwork shall be ~n the sole discretion of Arts Council. <br /> <br />6. Reorese*tationsand Warranties. "AS-IS" Condition. County shall <br />lease and Arts Council *cepts the Premises in its "AS-IS" condition. County makes no <br />warranties or representations regarding the Premises and no warranties are implied. Arts <br />Council shall hold COlll\ty harmless for any defects in the Premises created by Arts <br />Council during its tenancy. <br /> <br />7. Reoair a~d Care Of Premises. Arts Council shall not Use or permit the <br />use of the Premises in VIolation of any present or future applicable law of the United <br />States or of the State of North Carolina, or in violation of any present or future <br />applicable municipal Or~inance or regulation. Arts Council, upon the written consent of <br />County, may, but at Art~ Council's own cost and expense and in a good workmanlike <br />manner, make such alter~tions and improvements on the Premises as Arts Council may <br />require for the Arts Co~cil's use and without, however, materially altering the basic <br />character of the Premise$ and the building or improvements thereon or weakening any <br />structure on the Premise$. In addition, any approved improvements shall be done under <br />consultation with a competent architect and according to a general plan of organized <br />historic renovation and restoration. Any and all improvements made to the Leased <br />Premises or auditorium ~hall belong to the County, and the Arts Council shall not be <br />entitled to any reimburs~ments for the costs of said improvements. <br />I <br /> <br />8. Assi nin and Sublettin . Arts Council shall not sublet the Premises or <br />any part thereof nor assi this Lease. <br /> <br />9. Rie:hts ofiSuccessors and Asshms. The covenants and agreements <br />contained in the within pease shall apply to, inure to the benefit of, and be binding upon <br />the parties hereto and, up~n their respective successors in interest, except as expressly <br />otherwise herein provide~. This Lease and the exhibit attached hereto set forth <br />all the covenants, promis~s, agreement conditions and understandings between County <br />and Arts Council concenpng the Premises, and there are no covenants, promises, <br />agreements, conditions ot understanding, either oral or written, between them other than <br />as herein set forth. Excep~ as herein otherwise provided, no subsequent alteration, <br />amendments change, or r. dition to this Lease shall be binding upon County and Arts <br />Council unless reduced t . writing and signed by them. Arts Council agrees that County <br />and County's agents hav i made no representations or promises with respect to the <br />Premises or the building ~r the property which are a part thereof except as herein <br />expressly set forth. . <br /> <br />11.
