<br /> <br />Memo <br /> <br />To: Cabarrus County Planning and Zoning Commission <br />From: Rodger Lentz, Planning and Zoning Manager <br />Date: October 27,2005 <br />Re: Request for Extension of Preliminary Plat Approval <br /> <br />Attached, please find a letter requesting an extension for the approval of the Peach Orchard Estates <br />preliminary subdivision plat. A copy of the plat map is also enclosed. Per the Cabarrus County <br />Subdivision Ordinance Chapter 3, Section 5, a preliminary plat approval is valid for a period of 24 <br />months from its approval date. In addition, this project is subject to a consent agreement that also <br />expires two years from approval. The plat was originally approved on January 15, 2004 <br /> <br />Staff recommends that the board determine if the applicant has acted in good faith to develop the <br />project in a timely manner. This might include discussion of whether the applicant has prepared <br />construction drawings and received any necessary grading, utility, road, and other applicable approvals <br />for the project. If the board finds that the developer has acted in good f<lith to deveiop the project staff <br />recommends: <br /> <br />1. That the developer be granted a one year extension for the development of this project - <br />setting the new expiration date at January 15, 2007 (please note the developer requested a <br />two year extension). <br /> <br />2. That the developer meet the following additional standards for subdivision development: <br /> <br />a. Plant street trees in accordance with Subdivision Ordinance Chapter 4, Section 11, <br />item 10. <br /> <br />b. Buffers comply with the pianting and tree preservation requirements of Section 5-8, <br />Item D in the Cabarrus County Zoning Ordinance. <br /> <br />c. Open space areas comply with Section 5-8 of the Cabarrus County Zoning <br />Ordinance. <br /> <br />d. Homes within the develop meet the architectural requirements found in Section 5-7, <br />item E and Section 5-8, items E and F of the Cabarrus County Zoning Ordinance. <br /> <br />3. That the extension be conditioned upon the Cabarrus County Board of Commissioners <br />reaffirming or renegotiating the terms of the original consent agreement. <br /> <br />Please note the reason behind this recommendation: <br /> <br />The development no longer meets the Cabarrus County standards for subdivision development <br />in this area. The area is presently zoned CR (it was previously zoned LOR).
