<br />+ Chapter Thirteen Amendments & Changes <br /> <br />Because both all three options for rezoning have more similarities than <br />differences, one procedure for filing is set forth below. The few differences are <br />emphasized in bold. <br /> <br />-Step 1: Filing Application. The Petitioner must file the appropriate Cabarrus <br />County Rezoning Application form within the Commerce Department along with a <br />fee as set by the County Board of Commissioners. Applications for amending the <br />atlas must include: <br /> <br />1. Name(s) and address(es) of the owners of the proposed rezoning. <br /> <br />2. Name(s) and address(es) of all abutting property owners (including <br />those across a right-of-way), including all on site easement holders. <br /> <br />3. A legal description or survey of the property proposed for <br />rezoning. <br /> <br />If rezoning to an "SU" or "CD" district is desired, petitioner also submits a <br />development plan as described in Section 13-9 or 13-11, part 3 at this time. <br /> <br />-Step 2: Staff Review. The Commerce Department staff review the submitted <br />application. If the rezoning is to an "SU" or "CD" district, the staff also reviews <br />the proposed development plan. After review, the staff will again meet with the <br />petitioner to discuss its recommendation. The petitioner may refuse or accept <br />staff recommendations. <br /> <br />-Step 3: The Planning and Zoning Commission. The Planning and Zoning <br />Commission shall consider all applications to amend the atlas or text of this <br />Ordinance at their regularly scheduled monthly meetings. Complete applications <br />shall be filed with the Commerce Department by the submission deadline without <br />exception so that staff evaluations can be accomplished. The Planning and Zoning <br />Commission's current regular monthly meeting date shall serve as the deadline for <br />scheduling an item for consideration by the Commission at its next regularly <br />scheduled monthly meeting. A complete application includes the required <br />application and filing fee as well as a site plan and other supporting documents <br />(when required by this ordinance) such as traffic studies, environmental studies, and <br />similar documents. <br /> <br />-Step 4: Planning and Zoning Commission Decision or Recommendations to <br />Commissioners. Within forty-five (45) days of hearing the presentation of the <br />application to amend, the Planning and Zoning Commission shall make a decision <br />on the rezoning petition or text amendment.
