<br />Cabarrus County, NC I Adequate Public Facilities Ordinance <br /> <br /> <br />1869 <br />$2 825 <br />$3 865 <br />$2,937 <br /> <br />The Board of County Commissioners may reduce the voluntary advance <br />payment if the applicant demonstrates that actual per-unit costs are less <br />than the amount shown. This demonstration may take into consideration <br />a reduction in the payments due to other contributions of taxes, fees, or <br />similar payments from the proposed development that are reserved for <br />capital improvements. <br /> <br />Section 15-13 to 15-20. Reserved. <br /> <br />Section 15-21. Appeals <br /> <br />1. If the Reviewing Agency is the Planning and Zoning Commission (except <br />for subsection 3, below), any person that is aggrieved by the decision of <br />the Planning and Zoning Commission as it relates to this ordinance, may <br />within thirty (30) days of the Planning and Zoning Commission's decision, <br />petition the Board of County Commissioners for review of the Planning <br />and Zoning Commission decision. The Board of County Commissioners <br />may affirm, reverse, or remand the decision of the Planning and Zoning <br />Commission for further proceedings. The Board of County Commissioners <br />may reverse or remand the decision of the Planning and Zoning <br />Commission if it finds that the decision was based on an error of law, an <br />incorrect interpretation of this Chapter, or if the application of this Chapter <br />would resolve in a deprivation of the reasonable use of the applicant's <br />property. <br /> <br />2. If the Reviewing Agency is the Board of County Commissioners, their <br />decision may be appealed by any aggrieved person to the Cabarrus <br />County Superior Court. <br /> <br />3. If the Reviewing Agency is the Planning and Zoning Commission serving in <br />its capacity as the Board of Zoning Adjustment, an appeal must be filed as <br />provided in Sections 12-25 and 12-26 of this Chapter. <br /> <br />Section 15-22.
