As I <br />communicated to you ou December 3'd in Bits and Pieces, the conlIact is based on the Office of State <br />Construction's model, which bas been refined several times to reflect the state's very positive experience <br />with this relatively new (to North Carolina) construction delivery method, <br /> <br />Also included in the December 3,d communique were the general bnsiness terms, provided again below: <br /> <br />1. Preconstruction fee: lump sum $320,000 <br />2. Allocation of items between the construction management fee and the geueral conditions will <br />follow the Office of State Construction document: "Appeudix H: Division of Project Cost <br />Elements" (attached) <br />3. Insurance to be provided by Turner: I) Contractor Controlled Insurance Program "CCIP" for <br />GLIWC; 2) Builders Risk Insurance; 3) SubconlIactor Default Insurance a.ka "Subguard" <br />4. Shared savings: none, all savings will inure to County <br />5, Liquidated Damages: $1,000 per day <br />6. Insert language stating that Turner will make a good faith effort to ensure that Cabarrus County- <br />based companies have an opportunity to be awarded sub conlIacts <br />7. There will be one Guaranteed Maximum Price amendment, which will be revised and increased <br />with each subsequent phase of the project <br />8. Retainage on Turner's fee will be 5% <br /> <br />The fee for the construction manager at risk services can not be calculated until the project construction <br />documents are completed and the cost of work is detennined. The same is true for calculating the cost of <br />general conditions and the guaranteed maximum price. Consequently, the conlIact you are asked to approve <br />does not include these items, but rather provides a framework contemplating an amendment when that <br />infonnation is available, <br /> <br />An agreement was reached with Turner Construction providing that the combined Fee and General <br />Conditions will not exceed 15.52% of the cost of work, i.e., the average fee plus average general conditions <br />awarded on UNC system construction manager at risk projects.
