<br />(3) construction of the Law Enforcement Center and the Jail. <br /> <br />C. Proposal of Guaranteed Maximum Price. <br /> <br />(1) When the Drawings and Specifications are sufficiently complete, and the CM <br />has obtained responses to its request for bids, the CM shall propose a <br />Guaranteed Maximum Price for each Phase. <br /> <br />(2) Each Phase shall have its own proposed Guaranteed Maximum Price; <br />contingency; and General Condition costs for reimbursement; each of which <br />shall be subject to the provisions of this Contract. <br /> <br />D. Further.Develonment of Guaranteed Maximum Price. As the Drawings and <br />Specifications may not be finished at the time the Guaranteed Maximum Price Proposal is prepared <br />for each Phase, the CM shall provide in the Guaranteed Maximum Price for further development of <br />the Drawings and Specifications by the Architect that is consistent with the Contract Documents and <br />reasonably inferable therefrom. Such further development does not include such things as changes in <br />scope, systems, kinds and quality of materials, finishes or equipment. <br /> <br />E. Contin~encv Amount. The Guaranteed Maximum Price for each Phase shall include <br />a contingency amount not to exceed four (4%) percent of the total amount to be paid to <br />subcontractors for all of the labor, material and equipment to be used for the construction of each <br />phase and of the Project, which contmgency shall be used for those expenses or circumstances a <br />reasonably prudent construction manager could not have determined at the time the Guaranteed <br />Maximum Price was provided. The contingency shall be managed by the Architect and the <br />Construction Manager at Risk and a Construction Management Fee shall be paid only when any <br />portion of the contingency is disbursed. To the extent that any portion of the contingency is not used <br />for any Phase, such unused sums belong to the Owner, <br /> <br />F. Basis of Guaranteed Maximum Price. The CM shall include with the Guaranteed <br />Maximum Price Proposal a written statement of its basis which shall include: <br /> <br />(1) <br /> <br />A list of the Drawings and Specifications, including all addenda thereto which <br />were used in preparation of a Guaranteed Maximum Price Proposal. <br /> <br />A list of allowances and a statement of the basis for each, <br /> <br />(2) <br />(3) <br /> <br />A list of the clarifications and assumptions made by the Construction Manager <br />at Risk in preparation of the Guaranteed Maximum Price Proposal to <br />supplement the information contained in the Drawings and Specifications. <br /> <br />(4) <br /> <br />A statement of the estimated cost of construction organized separately by <br />trade categories; allowances; the Construction Management Fee; General <br /> <br />EE:00049951. <br /> <br />-10- <br /> <br />~.4 <br />
