<br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />CONTRACT <br /> <br />THIS AGREEMENT, is made and entered into effective July I, 2004 by and between <br />CABARRUS COUNTy, NORTH CAROLINA, a political subdivision of the State of North <br />Carolina with its principal place of business at 65 Church St. SE, Concord, <br />North Carolina 28020 (hereinafter referred to as "COUNTy"), and LUTHERAN FAMILY <br />SERVICES IN THE CAROLINAS, a North Carolina non profit corporation with its <br />principal place of business at 112 Cox Avenue,Raleigh, North <br />Carolina 27605 (hereinafter referred to as "LUTHERAN SERVICES"). <br /> <br />WITNESSETH <br /> <br />WHEREAS, The County, through its Department of Social Services hereinafter- <br />referred to as "DSS", is in need of homes to receive children placed in the <br />custody of DSS by the Courts, voluntary placements, or otherwise; and <br /> <br />,) <br />WHEREAS, Lutheran Services has agreed to establish one (1) receiving home for <br />such children; and <br /> <br />WHEREAS, Lutheran Services has had considerable experience in caring for <br />children and is licensed by the State of North Carolina to operate and maintain <br />the receiving home contemplated by this contract. <br /> <br />NOW THEREFORE, in consideration of the premises and the sums to be paid by the <br />County to Lutheran Services, the Lutheran Services does hereby contract with the <br />County to provide services of the type hereinafter described and upon the <br />following terms_and conditions: <br /> <br />1. Lutheran Services shall maintain one around-the-clock home in Concord, North <br />Carolina for the sole and exclusive use of DSS. The home shall provide <br />adequate, safe and comfortable housing with appropriate furnishings, qualified <br />care and supervision for not more than six (6) children at all times. DSS may <br />place such children in the home as DSS, in its sole discretion, deems advisable. <br /> <br />2. Lutheran Services shall provide room, board, adequate properly trained house <br />parent staff supervision, routine school supplies, and allowances for children <br />placed in the home. Each child will be afforded meals and have his/her <br />individual bed. Children will be roomed together based upon same sex and if <br />possible, proximity in age. Lutheran Services shall provide transportation for <br />each child to and from school, to medical appointments and to Mental Health <br />appointments and shall remain with them at said appointments. <br /> <br />3. Lutheran Services will schedule a physical exam with a physician's office or <br />appropriate public health facility for each resident within.7 days of admission <br />and provide the results of such exam to DSS. <br /> <br />4. Lutheran Services will meet with the school at each child's enrollment to <br />discuss his educational plan and will review this plan with the school each <br />month. <br /> <br />5. The County shall pay to Lutheran Services the sum of $17,445.11 per month <br />for July 2004 through June 2005, to maintain said home and to provide food, <br /> <br />J:-9 <br />
