<br />shelter, and the other services herein contemplated. The County will provide <br />clothing as determined by DSS based on the individual needs of the child. <br /> <br />6. The County through DSS will sign the Admission Agreement at the time of <br />placement of a child. The form Admission Agreement is attached hereto as Exhibit <br />~and incorporated as if more fully set forth herein. <br /> <br />7. The County through DSS requires that no equipment, furnishings or other <br />items be purchased out of service fees (JCPC and county funds) without prior <br />written approval of DSS. <br /> <br />8. Lutheran Family Services will keep a no smoking policy in effect for the <br />minors who are group home residents. No smoking by any individual will be <br />permitted within the home. <br /> <br />9. The County shall be responsible for the payment of any medical expenses <br />incurred by any child placed in the home other than routine first aid <br />administered by the home; provided, Lutheran Services may authorize emergency <br />medical treatment by licðnsed physicians should circumstances require. <br />Reimbursement for medical services is limited to Medicaid coverage only. <br /> <br />10. The County through DSS shall have the right to inspect the premises of the <br />home at any reasonable hour in order to ascertain that the children placed in <br />the group home are receiving adequate care and in the event the Count~ or DSS <br />has any reason to believe the children are not receiving adequate care, the <br />County or DSS will be permitted to inspect the premises at any time. Lutheran <br />Services represents and warrants to the County and DSS that it currently has all <br />licenses and permits reqUired to operate the home and agrees to at all times <br />maintain all licenses and permits necessary to operate the facility. Lutheran <br />Services will notify DSS immediately upon the loss or threatened loss of any <br />required lic:ns~ or permit. <br /> <br />11. The beds and services provided in the home shall be for the exclusive use <br />and benefit of children in the custody of the DSS and Lutheran Services shall <br />not permit such facility to be occupied by children from any other agency <br />without the express prior written agreement of DSS. <br /> <br />12. This Agreement is effective from July 1, 2004 through June 30, 2005. <br />However, this contract may be terminated by either party upon sixty (60) days <br />prior written notice for no default or non-appropriation of funds by the County <br />for this service. In such event, Lutheran Services shall provide the services <br />and the County shall pay for the services through the date of termination and <br />shall no further obligation or liability to Lutheran Services. In the event <br />either party defaults under this Agreement, the non-defaulting party shall have <br />the right to terminate this Agreement immediately. <br /> <br />13. It is understood and agreed that Lutheran Services is an independent <br />contractor and not an agent for and may not act on behalf of the County. <br />Furthermore, Lutheran Services warrants and represents that it has and will <br />maintain competent, qualified and sufficient staff to properly supervise the <br />children placed in the home at all times. Lutheran Services represents and <br />warrants that all persons employed by Lutheran Services will have agreed to and <br />undergone a background screening check prior to coming into contact with the <br />children and that all individuals employed by Lutheran Services will have <br />received clean background screenings with regard to any allegation or charge <br />that would indicate or pose any risk or threat to the safety and well-being of <br />the children.
