<br />WHEREAS, the County recognizes that the planning process for the.update, adoption and <br /> <br /> <br />implementation of the Land Use Plans, Zoning Ordinance, Subdivision Regulations and other <br /> <br /> <br />land use-related administrative regulations and ordinances will require approximately six (6) <br /> <br /> <br />months, during which time applications for major preliminary residential subdivision plat <br /> <br /> <br />approval will hot be accepted, processed or approved until the termination of this Interim <br /> <br />Development Ordinance; and <br /> <br />WHEREAS, due to unabated growth pressures throughout the County, it is imperative <br /> <br /> <br />that the County take appropriate action before problems become unsolvable and planning options <br /> <br /> <br />are irretrievably lost; and <br /> <br />WHEREAS, adequacy of public facilities including, but. not. limited to, schools, <br /> <br /> <br />transportation, storm water management and sewer. and water provision are of immediate <br /> <br />concern; and <br /> <br />WHEREAS, the County has determined that an Interim Development Ordinance shaH be <br /> <br /> <br />adopted and put into effect until the planning process is complete, including but not limited to <br /> <br /> <br />the update and adoption of Land Use Plans and revision and adoption of the Zoning Ordinance, <br /> <br />Subdivision Regulations, and establishment. of districts and other land use related administrative . <br /> <br /> <br />regulations and ordinances as neccessary; and <br /> <br />WHEREAS, the interim development ordinance does hereby prohibit, restrict, or regulate <br /> <br /> <br />the processing and approval of any sketch plats, major preliminary residential subdivision plats; <br /> <br />and <br /> <br />WHEREAS, certain applications for land use approval may result in disputes over the <br /> <br />existence and scope of vested rights for said land use approvals pursuant to NCGS I 53A-344. I <br /> <br /> <br />and the common law; and <br /> <br /> <br />WHEREAS, the continued development in the County without actions taken to manage <br /> <br /> <br />growth, establish appropriate uses, intensities, design, compatibility, environmental protection, <br /> <br /> <br />ensure the adequacy of public facilities in the County and other county, city, state or regional <br /> <br /> <br />service providers, poses an imminent and emergency threat to the public health. safety and <br /> <br /> <br />general welfare of the County; and <br /> <br /> <br />WHEREAS, this ordinance will promote thehea1th, safety, and general welfare of the <br /> <br /> <br />citizens of Cabarrus County, prevent overcrowding of land, avoid. undue concentration of <br /> <br />3 <br /> <br />v <br />",..,. <br /> <br />Gr..1 <br />
