July 21, 2003 Page 184 UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and unanimously carried, the Board adopted on second reading the "Resolution and Ordinance Renewing a Non-Exclusive Franchise to Mid-State Transport, Inc., for the Operation and Regulation of a Non-Emergency Ambulance Service within Cabarrus County, North Carolina, Pursuant to the Terms of that Certain Ordinance Adopted September 4, 1990, and Constituting the Franchise Agreement Referred to Therein" (set forth on Pages 155-157 of the minutes for the Meeting on June 16, 2003); and approved the renewal of the non-exclusive franchise agreement and authorized the County Manager to execute the ~Agreement for Franchise of Transportation Services for Cabarrus County Non- Emergency Transportation Services" on behalf of Cabarrus County. (E-2) Authorization ~o Award Service Weapons to Retiring Officers Gerald W. Kr4~4n~er and Irene Russell UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and unanimously carried, the Board, pursuant to North Carolina General Statute 20-187.2, declared surplus and authorized the award for the price of $1.00 the service weapons to the following officers upon their retirement on September 1, 2003: Gerald W. Kr~mminger - Smith & Wesson, 9MM, Model: 5906; Serial #VJH0648; and M. Irene Russell - Smith & Wesson, 9MM, Model: 5906; Serial # VAV3387. (E-3) Resolution Authorisin~ the Ex-hence/Trade-In of Weapons b~ the Cm~ar~;- Count~ Sheriff's Department in Securing New Weapons from Si~ Am, Inc. The Cabarrus County Sheriff's Department intends to purchase 160 Sig P226 weapons during Fiscal Year 2004. The exchange/trade-in of 147 Smith & Wesson 5906 weapons currently used by the department will reduce the cost of the new weapon purchase. The Public Notice of Exchange/Trade-In was published in THE INDEPENDENT TRIBUNE on June 30, 2003. UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth and unanimously carried, the Board adopted the following Resolution authorizing the exchange/trade-in of county-pwned weapons. Resolution No. 2003-22 STATE OF NORTH CAROLINA ) ) RESOLUTION CABARRUS COUN~ ) WHEREAS, Cabarrus County owns 147 Smith & Wesson 5906 (weapons) and valued at $36,750 collectively; and WHEREAS, Sig Arms, Inc. of New Jersey owns 160 Slg P226 (weapons) and valued at $88,000 collectively; and WHEREAS, the County desires to purchase 160 Sig P226 (weapons) from Sig Arms, Inc. while trading-in 147 Smith & Wesson 5906 (weapons); and WHEREAS, North Carolina General Statutes 143-129.7 and 160A-271 authorizes the County to make such an exchange/trade-in if authorized by the Board of Commissioners by a resolution adopted at a regular meeting of the hoard upon at least 10 days' public notice; and WHEREAS, the County has given the required public notice, and the board convened in a regular meeting. THEREFORE, THE BOARD OF CO~ISSIONERS OF CABARRUS COUNTY RESOLVES THAT: 1. The exchange/trade-in of personal property described above is authorized. 2.
