Resolution No. 2005-.__ CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLUTION AUTHORIZING THE TAX COLLECTOR TO DIRECT EXECUTIONS AGAINST PERSONAL PROPERTY TO THE SHERIFF OF CABARRUS COUNTY FOR COLLECTION WHEREAS, the Tax Collector is authorized under N.C.G.S. 105-367 to direct an execution to the Sheriff of Cabarrus County to levy upon and sell personal property for the collection of taxes upon approval by a resolution of the governing body of the taxing unit; and WHEREAS, Cabarrus County has entered into interlocal agreements with other towns within the County to serve as the towns' tax collector in the listing, assessing, billing and collection of taxes with full authority to make all decisions involving collection procedures; and WHEREAS, the Tax Collector has requested the Board of Commissioners to adopt a resolution authorizing the Tax Collector to direct to the Sheriff of Cabarrus County executions for the collection of motor vehicle taxes and other personal property taxes against such taxpayers as the Tax Collector chooses from time to time; now, therefore be it RESOLVED by the Cabarrus County Board of Commissioners that the Tax Collector is authorized to direct to the Sheriff of Cabarms County executions to levy upon and sell personal property for the collection of delinquent motor vehicle taxes and other personal property taxes. The Sheriff shall have the right to levy upon and sell the personal property under the same powers and authority normally exercised by sheriffs in levying upon and selling personal property under execution.
