Once the matter <br />was given to me to prepare the necessary documentation to effectuate the transfer I discovered <br />that the statutes do not allow for a gift of real property by the School Board. <br /> <br /> Therefore the School Board will give the property to the County and the County can give <br />the property to Habitat. Section 160A-279 allows for the County, but not the School Board, to <br />convey by private sale any real property to a private entity, that ~s not a for profit corporation and <br />which carries out a public purpose, in heu of any appropriation ]t is authorized to make. The <br />public purpose for the transfer is two fold: l) Habitat and the schools have agreed that the <br />vocational students from various schools will participate in the construction of the home <br />providing valuable hands on education; and 2) HaNtat will have land to build an affordable <br />decent home for a famdy in this commumty who would otherwise have to live in substandard <br />housing. <br /> <br /> Habitat ts asking that County Commissioners vote to transfer the Edwards Avenue lot to <br />them at the October meeting. I am enclosing a copy of the resolution approving the transfer as <br />well as a copy of the deed Once the resolution has been adopted ~t needs to be published for a <br />per]od of 10 days prior to the transfer being consummated. <br /> <br />Please let me know if there are any questions. <br /> <br />Slncere..ly, <br /> <br />David C.
