<br />release unto the C~ty of Concord, N C. ("Grantee"), its successo'rs, assigns and licenses, the right, pnvflege and easement
<br />to enter and re-enter at any time and to install, d~g, build, erect, maintain, repair, rebuild, operate, and patrol one or more
<br />electric power transmission lines and/or other public ubl~tles over ground or underground, and one or more telephone,
<br />cable telews~on, fiber opbc or commumcations line(s) over ground or underground, including the right to erect poles and
<br />other transmission line structures, wires, cables, p~pes, and any necessary appurtenances for the proper conduct of
<br />electricity, electronfc ~nformabon, data, communications, water, sewer and other public util~bes, the r~ght to clear the right
<br />of way and keep ~t clear of brushes, trees, buildings, and fire hazards, and the right to remove trees, if any, located
<br />beyond the limits of the right of way, but which ~nterfere with the right of way; the above described rights being incident to
<br />performance by the Grantee of its functions as a mumc~pal~ty or as the operator of any public ublities system, or the
<br />performance by any I~censee of the Grantee of any public utilities functions, the premises to be affected hereby being as
<br />follows.

<br /> All that certain strip of land s~tuated ~n Cabarrus County, North Carolina, w~thin the boundaries of or in the wcimty of
<br />north s~de of M~dland Road, same being twenty feet in w~dth and extending for an approximate length of eight hundred
<br />seventy five (875') feet See attached exhibits A, B, C

<br /> Together w~th any .and ali rights normally incident thereto, and parbcularly the nght of ingress and egress thereto
<br />Irom brae to time as necessary for construcbon, reconstruction, enlargement and/or maintenance.
<br /> To have and to hold the same unto the City of Concord, N C, its successors and assigns forever
<br /> And the Grantor(s) hereby represent(s) that said premises are owned by the undersigned ~n fee and are not
<br />;ubject to any mortgage or lien whatsoever, except as follows
<br /> the holder of such encumbrance(s), by
<br />o~n~ng in the execubon hereof, hereby waive(s) ~n favor of and subordinates to the rights hereby granted.

<br /> The Grantor(s) shall have the right to use the ab0ve-descrlbed strip for purposes not Inconsistent with Grantee's
<br />JII enjoyment of the r~ghts hereby granted, provided that the Grantor(s) shall not erect or construct any building or other
<br />tructure thereon; maintain or permit any underground or over ground system of p~ping, poles or w~rlng within such strip;
<br />hake any use oi' the facilities installed, buried, erected, or constructed thereon; or drill or operate any well or sepbc
<br />ystem w~thln such str~p, w~thout the express written permission of the Grantee.
