Lobbying." <br /> <br />SUBCONTRACTOR has implemented a written and enforced conflict of interest policy <br />consistent with the National Science Foundation Policy, "Investigator Financial <br />Disclosure Policy,'" as published in the Federal Register, July 11, 1995, and with any <br />subsequent amendments to the policy. <br /> <br />5. It is in compliance with the Drug-Free Workplace Act of 1988, Public Law 100-690, Title <br /> V, Subtitle D. 34 CFR Part 85, Subpart F. <br /> <br />o <br /> <br />Public Law 103-227, Part C-Envirom~ental Tobacco Smoke, also known as the Pro- <br />Children Act of 1994 (Act), requires- that smoking not be permitted in any portion of any <br />indoor facility owned or leased or contracted for by an entity and used routinely or <br />regularly for the provision of health, day care, education, or library services to children <br />under the age of 18, if the services are funded by Federal programs either directly or <br />tlu'ough State or local governments, by Federal grant, contract, loan, or 10an guarantee. <br />The law does not apply to children's services provided in private residences, facilities <br />funded solely by Medicare .or Medicaid funds, and portions of facilities used for inpatient. <br />drug or alcohol treatment. Failure to comply with the provisions of the law may result in <br />the imposition of a civil monetary penalty of up to $1,000 per day and/or the imposition' <br />of an administrative compliance order on the responsible entity. SUBCONTRACTOR <br />certifies that it will comply with the requirements of the Act. SUBCONTRACTOR <br />further agrees that it will require the language of this certification be included in any <br />subawards which contain provisions for children's services and that all subgrm~tees, shall <br />certify accordingly. <br /> <br />SUBCONTRACTOR, by signature affixed to tlfis Subcontract, agrees to notify NCSU <br />inm~ediately if there is any change of status of subparagraphs 1 tlu'ough 6.of paragraph A <br />above. <br /> <br />XIV. ASSURANCES: <br /> <br />Ao <br /> <br />Civil Rights and Equal Employment Opportunity: The SUBCONTRACTOR shall comply <br />with Title VI and VII of the Civil Rights Act of 1964, and Executive Order 11246 and <br />certifies that it has a valid Assurance of Compliance on file with the DHHS (Form HHS 441). <br />The SUBCONTRACTOR agrees to include in any contract entered into pursuant to this <br />Agreement paragraphs { I } through {7}, Part II, Subpart B, section 202, Executive Order <br />11246. <br /> <br />Bo <br /> <br />Protection of Human Subjects: Any activity under this Agreement which involves the use of <br />human subjects shall be governed by applicable policies and federal regulations.
