The attached proposed lease and operations agreement outlines the following major <br />points: <br /> <br /> · Cabarrus County will retain ownership of the property and all structural <br /> improvements. <br /> · The agreement spells out responsibilities and obligations between the City and the <br /> County. <br /> · Cabarrus CountY agrees to apply for voluntary annexation (to City of Concord) for <br /> this site. <br /> · The City of Concord agrees to manage, operate, program, maintain and supervise <br /> use of the park. <br /> · The term of the lease is for twenty years. The lease may be extended for a second <br /> twenty-year term if approved by both groups. <br /> · The City of Concord agrees to pay for all associated costs of this park site (utilities, <br /> telephone, maintenance, operations, etc.). <br /> · The City of Concord agrees to be'responsible for the general repairs, replacement, <br /> and maintenance of all park facilities on the site. <br />'- All signage must state that the County and the City are joint partners on this park <br /> site. <br /> · The City will be allowed to solicit athletic field sponsorship for the purpose of <br /> offsetting operations and maintenance expenses for the complex. <br /> · 'The City will be responsible for re-sprigging the four athletic outfields, landscaping <br /> park areas and designing and constructing sidewalks at the park. The County <br /> agrees to pay the City $40,000 to assist with the cost of this work. These funds are <br /> in the Cabarrus County approved Capital Improvement Budget.for W.W. Flowe <br /> Park. The City of Concord agrees to supervise and coordinate these project <br /> elements. The City also agrees to pay all invoices for these services, and shall be <br /> solely responsible for all costs in excess of $40,000 needed to complete re- <br /> sprigging, landscaping and concrete sidewalks. <br />· The City may develop additional park facilities at a later date with the prior written' <br /> consent of the County. <br /> <br />On Thursday, March 28, 2002, the City of Concord Council approved the attached <br />agreement.
