Planning and Zoning Commission Minutes
July 18, 2002

Page 5

of Commissioners approved the petition. With that approval they
amended the Western Area Plan to change that area that was
designated residential to industrial. The approval was in January of
1998. Mr. Lentz said Mr. Motley did vest some rights to build
houses on the property. The vested right was extended now it is
about to expire, that is why Mr. Motley is back before the Board
tonight because he wants to have it down zoned so they can
continue to explore the purchasing of houses.

Mr. Lentz said the Morley's are loOking at building some houses.
The intention of this rezoning is to allow for the building of no more
that 15 single-family homes on these properties; however, the
growth of this area is geared towards industrial and future
employment uses and not towards continued residential
development. He said based on the amendment to the Western
Area Plan, staff cannot recommend approval of the petition.

The Chair opened the Public Hearing on Petition C02-02(R).

Mr. Wayne Motley, Applicant, addressed the Board stating what Mr.
Lentz just said really surprised him because Jonathan Marshall
suggested that he do this. He said they have been living out there
every since the airport has been out there. Tt is not going to
bother them. Mr. Motley said all they are asking to do is to be able
to build some family homes there. He said they already have four
homes there now. He said he is not financially able to build the
homes right now and his five-year extension will be running out at
the end of the year. Mr. Motley said they are asking, the Board to
let them put the property back in the MDR zone so they can build
their home and raise their family.

Mr. Benton asked how many homes are currently on the property
and who lives in those homes.

Mr. Motley said there are four homes. His daughter, his brother's
two sons and his brother have a house there.

Mr. Hill asked Mr. Motley how many acres are involved in this tract
of land.
