BE IT RESOLVED THAT THE CABARRUS COUNTY BOARD OF EDUCATION <br /> HEREBY, requests approval from the County to transfer up to <br /> $1,300,000 from the Local Current Expense fund to the regular <br /> Capita~ Outlay fund for the 2002-03 fiscal year. <br /> <br /> Approved this __ day of August, 2002. <br /> <br /> Cabarrus County Cabarrus County <br /> Board of Commissioners Board of Education <br /> /s/ Grace Mynatt <br /> Mr. Robert Freeman, Chair Mrs. Grace Mynatt, Chair <br /> /s/ Harold Winkler <br /> Mr. Frank Clifton Dr. Harold Winkler <br /> County Manager Superintendent <br /> 8/~3/02 <br /> Date Date <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Fennel <br />and unanimously carried, the Board approved the request by the Cabarrus <br />County Board of Education to transfer up to $1,300,000.00 from the Local <br />Current Expense fund to the regular Capital Outlay fund for the 2002-03 <br />fiscal year. <br /> <br />(F-10) Rec~uest b~ the Cabarrus Board of Education to Use the FY 2002 <br />Carryover Funds from ~rounds Maintenance for Other Expenditures <br /> <br /> The Board received a Memorandum dated August 12, 2002 from Dr. Harold <br />Winkler, Cabarrus County School Superintendent, outlining the following <br />request. <br /> <br /> In accordance with our previous conversations, please use this <br /> memorandum as an official request from our Board of Education to <br /> provide flexibility in use of grounds carryover funds from the <br /> 2001-02 fiscal year. Particulars of the request are as follows: <br /> <br /> · The carryover funds were generated primarily from reduced mowing <br /> cycles over the past few years due to drought conditions. <br /> · The funds would be used on one-time expenditures, primarily for <br /> Capital Outlay. <br /> · The final carryover for 2001-02 from the grounds maintenance was <br /> $469,592 and would be distributed as follows: <br /> <br /> Cabarrus County Schools (82.4%) $ 386,944 <br /> Kannapolis City Schools (17.6%) 82,648 <br /> <br /> (The percentages above reflect Cabarrus and Rowan ADM funding as <br /> required by the Consolidated Maintenance agreement) <br /> · Upon approval, we will forward a check to Kannapolis City Schools <br /> for their ~hare. <br /> <br /> There was brief discussion regarding the request, including the <br />importance of adequate building and grounds maintenance for the two school <br />systems. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Suggs <br />and unanimously garried, the Board approved the request as submitted by Dr. <br />Harold Winkler, Cabarrus County School Superintendent, to use FY 2002 <br />carryover funding ($469,592.00) from grounds maintenance for other <br />expenditures. <br /> <br /> (F-11) Resolution to Authorize a Lawsuit to Recover Reimbursement and <br /> <br />Receipt of Revenue Due the County of Cabarrus Bein~ Illegally Withheld by the <br />State of North Carolina <br /> <br /> Commissioner Privette commented on the State's withholding of $334 <br />million in funds to the counties '($125 million) and to the cities ($209 <br />million) in North Carolina. He stated that Mr. Gene Boyce of Boyce & Isley, <br />PLLC, had proposed to file a lawsuit against the State for.the funds that had <br />been "illegally" withheld from the counties and municipalities. Commissioner <br />Privette suggested that Cabarrus County join in this lawsuit which would <br />recoup funds for those entities that are a party to the lawsuit. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Fennel <br />and unanimously carried, the Board adopted the following Resolution <br /> <br /> <br />
