4 Chapter 5 i, the contractor's application and any addenda thereto are incorporated herein by reference as though set forth verbatim. 13. Survival of Promises: All promises, requirements, terms, conditions, provisions, representations, guarantees, and warranties contained herein shall survive the contract expiration or termination date unless specifically provided otherwise herein, or unless superseded by applicable Federal or State statutes of limitation. 14. Availability of Funds: The parties to this contract agree and understand that the payment of the sums specified in this contract is dependent and contingent upon and subject to the appropriation, allocation, and availability of funds for this purpose to the Department and Office by the N.C. General Assembly and the federal government. 15. Responsibilities of the Division: A. Reimbursing the Contractor for the costs of services and activities described in the contract's approved work plan and budget (Attachment I) and in accordance with the financial requirements as established by the Office and the Department; B. Monitoring the Contractor for compliance with the terms of this Contract and applicable federal and state rules and regulations; and C. Specifying all reports and deliverables required from the Contractor. 16. Responsibilities of the Contractor: A. Performing in a manner satisfactory to the Office and the Department those requirements, responsibilities and activities which are included in Rule NCAC Title 10 Chapter 51 and in the Contractor's approved work plan and budget (Attachment I) and in accordance.with the terms of this Contract; B. Expending Contract funds in accordance with cost and accounting standards of the Office of Management and Budget Circulars A-110 (Administrative Standards for Grants and Cooperative Agreements to Non-Profit Organizations), codified at 45. CFR Part 74, and A-122 (Cost Principles for N6n-Profits Organizations); C. Making available all records, papers, vouchers, books, correspondence or other documentation or evidence relevant to the execution of this Contract at all reasonable times for review, inspection or audit by duly authorized officials of the Office Department, or the North Carolina Office of the State Auditor or federal officials. The Contractor agrees that the Office or its agent may have the right to audit the records of the Contractor pertaining to this Contract both during performance and after completion; D. Submitting to the Office or to another applicable agency, in such form as specified by the Office, a monthly expense report of expenses indurred during the previous month;
