There was brief discussion regarding funding for the school projects <br />and the additional debt service that would occur if the COPs are sold in <br />early 2003. It was noted during the discussion that funding for a new <br />Kannapolis Middle School would be contingent on the passage of the November <br />5~h school bond referendum in Rowan County. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Freeman and <br /> unanimously carried, the Board agreed to proceed with preparations for the <br /> <br />· Bethel Elementary replacement school as requested by the Cabarrus County <br /> Board of Education and approved the grading contract for Phase I with Culp <br /> Brothers ($593,931.00), the contract with Qore Property Sciences for soil <br /> testing ($18,200.00) and the steel contract with Southern Engineering <br /> ($649,600.00). The Board will provide the necessary advance funding for the <br /> grading contract and the testing by Qore with the County to be reimbursed <br /> when the Certificates of Participation (COPs) are sold. Southern EngineerIng <br /> has agreed to provide shop drawings and submittals up front at no cost to the <br /> Owner until funding is in place via the sale of the COPs. <br /> <br />(F-5) Appeal of C02-05(S) - Denial of Preliminar~ Plat Approval for the Ernie <br />Irvan Subdivision <br /> <br /> MS. Kelly Sifford, Community Development Manager, presented 'Petition <br />C02-05(S), the preliminary plat approval for the proposed Ernie Irvan <br />Subdivision to. be located off Odell School Road. The developer (Simonini <br />Builders, LLC) plans to develop 20 lots on 60.137 acres with water to be <br />provided by the City of Concord or through private wells. According to Ms. <br />Sifford, the subdivision design requirements have been met. However, she <br />explained that the Planning and Zoning Commission denied the preliminary plat <br />approval based on inadequacies of public school facilities. The developer <br />has proposed $500.00 per lot to advance school capacity (letter dated <br />September 17, 2002, from Ray S. Killian, President of Killian/Simonini, LLC). <br /> <br /> Commissioner Fennel questioned the average price of the homes to be <br />built in the subdivision. <br /> <br /> Mr.. Alex Simonini estimated the cost of the homes at a minimum of <br />$600,000.00 per home, including the lot at $70,000.00 per acre. He stated <br />the minimum lot size would be two acres. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Suggs and <br />unanimously carried, the Board approved the preliminary plat [Petition C02- <br />05(S)] for the Ernie Irvan Subdivision based on staff recommendations and <br />including the following conditions: (1) A soil and erosion control plan must <br />be submitted to Cabarrus County Erosion Control prior to the commencement of <br />any land disturbing activities; (2) The revised plat should include a <br />statement regarding the maintenance of open space; (3) Obtain an approved <br />water service plan from the State of North Carolina prior to final plat <br />approval if developers use public water or provide private wells; (4) Street <br />names must be approved for Emergency 911; and (5) Developer must enter into a <br />consent agreement with the Board of Commissioners. The Board authorized the <br />County Manager to enter into a Consent Agreement with. the developer, <br />including the donation of $500.00 per lot to address school adequacy issues, <br />'on behalf of the County. <br /> <br />(F-6) Appeal of C02-06(S) - Denial of Preliminar~ Plat A~proval for Highland <br />Hills Subdivision <br /> <br /> Ms. Kelly Sifford, Community Development Manager, presented Petition <br />C02-06(S), the preliminary plat approval for the Highland Hills Subdivision <br />to be located off Piney Church Road. The developer (Craft Homes) plans to <br />develop 320 lots on 71.388 acres with water and sewer to be provided by the <br />City of Concord. The prior developer had an approved Consent Agreement that <br />included a contribution of $500.00 per lot for school facilities and a <br />donation of $35,000.00 for recreation advancement in place of open space <br />within the subdivision. If the subdivision is approved, a new Consent <br />Agreement· will be needed as the developer has redesigned the project to <br />include open space. Ms. Sifford reported the Planning and Zoning Commission <br />voted to deny the proposal based on traffic and adequate public facilities <br />concerns as well as design dislike. She explained Craft Homes has proposed <br />customized development and has reached the maximum density of 4.5 dwellings <br />per acre. Further, the developer has off~red $500.00 per lot to help with <br />inadequate school availability (letter from David Cuthbertson of Craft Homes <br />USA LLC). <br /> <br /> Commissioner Fennel questioned the price of the homes to be built in <br />the subdivision. <br /> <br /> <br />
