COMPARZSON AND ANALYSTS WZTH EX](STZNG ORDZNANCE <br /> <br />ART1'CLE 4 <br /> <br />Purpose: This article establishes the various zoning and overlay districts to <br />regulate the use of land in Cabarrus Countyi. 'Article 4 also establishes and the <br />permitted and conditional uses for each district. <br /> <br />Major Points Discussed: <br />· Establishes each zoning district and describes their purpose and intent <br />· Establishes an official zoning map and defines how boundaries of each zoning <br /> district will be interpreted. <br />· ]:ncludes a use matrix that establishes the uses permitted by right, uses <br /> permitted through supplemental use regulations (standards are defined in <br /> article 5), and conditional uses for each zoning district. <br />· Defines the dimensional and density requirements for each district. <br />· Provides a cluster development option for residential development - an <br /> important tool for the voluntary preservation of open 'space. <br />· Creates Planned Unit Development, Traditional Neighborhood Development, <br /> and Transit Oriented Development districts that provide tools to allow <br /> developers to create self contained mixed use developments and transit <br /> supportive developments. <br />· Provides for several overlay districts that establish special standards in <br /> addition to those included for the underlying zoning district. For example the <br /> Airport Overlay is intended to protect the airport approach zones from tall <br /> structures such as telecommunications towers or the Watershed Protection <br /> Overlay which is intended to protect our water sources from pollution caused <br /> by excess runoff. <br />· Establishes a Manufactured Home Overlay district to establish areas 'where <br /> manufactured homes are permitted and to regulate the appearance of such <br /> structures (i.e. requiring underpinning or a pitched roof). <br />· Creates a Public Interest Development District to address land uses such as <br /> the Lowes Hotor Speedway. <br /> <br />Major Similarities/Differences: <br />Article 4 in the UDO replaces Chapters 3, 4, and 5 in the current zoning <br />ordinance. In the current ordinance Chapter 3 establishes each zoning district, <br />the zoning map, and provides a permitted use chart, Chapter 4 establishes each <br />overlay district, and Chapter 5 defines dimensional requirements and provides <br />tools that permit cluster development. .In this sense the overall intent is <br />identical between the two ordinances. The major differences between the UDO <br />and current ordinance is the UDO provides more detail in items such as the <br />permitted use chart, offers more flexibility through the establishment of new <br /> <br /> <br />
