COMPAR/SON AND ANALYSIS WITH EX~STZNG ORDZNANCE <br /> <br />ART:[CLE 13 <br /> <br />Purpose: Establishes standards for non-conforming uses and procedures for <br />establishing vested rights. <br /> <br />Major Points Discussed: <br /> <br />Major Similarities/Differences: <br />13.1 <br />Comparison of the Nonconforming Use Requirements <br /> <br />As you will see in the following review, the Unified Development Ordinance <br />addresses nonconforming uses in very much the same way as the existing <br />Cabarrus County Zoning Ordinance. ]:n fact, in some cases it may be even more <br />flexible than our current standards. <br /> <br />Nonconforminq land/lots of record- both the existing ordinance and the <br />UDO will permit the use of these parcels for anything allowed by the Table of <br />Permitted Uses as long as the proposed use can meet the setbacks and other <br />general development standards for the underlying zoning district. <br /> <br />The existing ordinance requires that all nonconforming lots that are contiguous <br />to another nonconforming lot and are in common ownership must be combined <br />to create a conforming lot prior to development. The UDO does not require this <br />to happen and will permit each lot to be developed if the. setbacks and general <br />development standards for the underlying zoning district can be met. <br /> <br />Expansion of nonconforminq uses- both the existing ordinance and the UDO <br />provide for a process in which a property owner can apply for "Certificate of Non- <br />Conforming Adjustment" in order to expand an existing nonconforming use. The <br />application process is identical in both the existing ordinance and the UDO, <br /> <br />Nonconforminq Mobile Home Parks- both the existing ordinance and the <br />UDO have the same requirements concerning nonconforming mobile home <br />parks. The total number of spaces existing at the time of the ordinance adoption <br />cannot be increased without Board approval, however individual mobile homes <br />may be removed and replaced on the existing lots. <br /> <br />Nonconforminq Mobile Homes- the existing ordinance will allow a <br />nonconforming mobile home to be removed and replaced as long as the <br />replacement home is not older than a 1976 model and must be completely <br />skirted. The UDO requires that any mobile homes that are replaced must Type <br /> <br /> <br />
