72

subdivision is connected to the Midland water line that was constructed
through the use of an Economic Development Grant. AS part of that grant, the
North Carolina Commerce and Finance Center requires a rei~ursement policy for
any users corunecting to the water line other than the intended industries.
This would result in a $500.00 per lot connection fee for the subdivision.
However, Mr. Humphrey objects to the fee due to his donation of the 23-acre
parcel and contends he was not informed of the fee. Mr. Marshall reviewed the
proposed actions to resolve the subdivision and water line fee issues. Me
pointed out that the proposal would have to be approved by the Board of
Commissioners and the Water and Sewer Authority.

NON HOTION of Chairman Fennel, seconded by Co~alssioner Freeman and
unanimously carried, the Board approved the following action concerning the
Rocky Meadows Subdivision aa proposed by Mr. Marshall:

1. Randy Mumphrey, Inc., complete the transfer of the 23-acre parcel to
Cabarz~/s County.
The Water and Sewer Authority of Cabarrus County (WSACC) transfers the
escrow amount of $129,859.00 to Cabarln/s County in exchange for the
transfer of 13 acres to WSACC.
3. Cabarrus County releases Randy Humphrey, Inc., from his obligated
payment of $35,500.00 due to Cabarrus County and pays the State of Worth
Carolina $35,500..00 for the State share of the cor~nection fee.
4. Cabarrus County retains $80,000.00 of the escrow amount (the expected
cost of the 13 acres for WSACC) plus an amount equal to half of the
connection fee paid to State ($17,750.00). Based on this the County
will retain $97,750.00 of the escrow amount.
5. Cabarz~s County returns the remainder of the -escrow amount to WSACC.
The amour returned would therefore be $32,109.00.

Stonewall Jaokson Soccer Co~lex

Proposed Soccer Facility A~reement between Cabarrus County, Ca30ar~s Soccer

Complex and the proposed Soccer Facility Agreement. Chairman Fennel pointed
and others who have worked on the project for a nuu%ber of years.

unanimously carried, the Board approved the following items concezning the
Stonewall Jackson Soccer Complex: (a) Approved the ~Agreement for Priority

Specified Recreation Facilities

public recreation facilities and i~rovements; and
WHEREAS, on or about the 23rd day of February, 2000, the County entered
in to a 25 year lease with the State of North Carolina (the 'Lease") for

approximately 11 new soccer fields and all necessary and attendant grading,
