AGREEMENT Agreement made the date first below written between the Cabarrus County Board of Education, a statutory body corporate of the State of North Carolina, (hereinafter CCBE) and the City of Concords a duly constituted municipal corporation of the State of North Carolina, (hereinafter City) to sell real property pursuant to N.C.G.S. 160A-274 as follows: . WHEREAS, the CCBE is the owner in fee simple of approximately three acres (plus or minus) or real property located in the 1400 block of Old Charlotte Road in the City of Concord, North Carolina currently part of the site of J.N. Fries Middle School and more particularly described in Exhibit A, which is attached hereto and incorporated herein; and WHEREAS, the CCBE desires to have the said real property improved to better serve the citizens of Cabarrus County, and particularly the students of j.N. Fries Middle School with improvements to the current softball field and related parking areas; and WHEREAS, the City desires to locate a fire station, police precinct office, and customer service center on said real property to better serve the citizens of Concord within Cabarrus County. NOW THEREFORE, for the reasons set forth above, the parties hereto agree as follows: For the sum of Fifty Thousand Dollars ($50,000), and the driveway improvement listed immediately below, the receipt of which is hereby acknowledged, the CCBE shall convey in fee simple and free of all encumbrances the approximately three +/- acres of land, more particularly described in Exhibit A to the City for the above purposes..The real property described has been determined to be unnecessary for public school purposes by the CCBE pursuant to N.C.G.S. 115C- 518. (a) The City will improve the current gravel driveway into a paved and guttered driveway, at least twenty-four feet wide, with sidewalks and fencing to access the track, ball field, and employee parking for the fire station and associated offices as set forth above. The City will own and maintain the driveway and give the School deeded right of access to the track and ball field parking lot.
