AGREEMENT <br /> <br />Agreement made the date first below written between the Cabarrus County Board of <br />Education, a statutory body corporate of the State of North Carolina, (hereinafter CCBE) <br />and the City of Concords a duly constituted municipal corporation of the State of North <br />Carolina, (hereinafter City) to sell real property pursuant to N.C.G.S. 160A-274 as <br />follows: . <br /> <br />WHEREAS, the CCBE is the owner in fee simple of approximately three acres (plus or <br />minus) or real property located in the 1400 block of Old Charlotte Road in the City of <br />Concord, North Carolina currently part of the site of J.N. Fries Middle School and more <br />particularly described in Exhibit A, which is attached hereto and incorporated herein; and <br /> <br />WHEREAS, the CCBE desires to have the said real property improved to better serve the <br />citizens of Cabarrus County, and particularly the students of j.N. Fries Middle School <br />with improvements to the current softball field and related parking areas; and <br /> <br />WHEREAS, the City desires to locate a fire station, police precinct office, and customer <br />service center on said real property to better serve the citizens of Concord within <br />Cabarrus County. <br /> <br />NOW THEREFORE, for the reasons set forth above, the parties hereto agree as follows: <br /> <br />For the sum of Fifty Thousand Dollars ($50,000), and the driveway improvement <br />listed immediately below, the receipt of which is hereby acknowledged, the <br />CCBE shall convey in fee simple and free of all encumbrances the approximately <br />three +/- acres of land, more particularly described in Exhibit A to the City for the <br />above purposes..The real property described has been determined to be <br />unnecessary for public school purposes by the CCBE pursuant to N.C.G.S. 115C- <br />518. <br /> <br />(a) The City will improve the current gravel driveway into a paved and guttered <br />driveway, at least twenty-four feet wide, with sidewalks and fencing to access the <br />track, ball field, and employee parking for the fire station and associated offices <br />as set forth above. The City will own and maintain the driveway and give the <br />School deeded right of access to the track and ball field parking lot. <br /> <br /> <br />
