MEMORANDUM OF UNDERSTANDING BETWEEN THE CABARRUS COUNTY <br /> BOARD OF ELECTIONS AND THE COUNTY OF CABARKUS <br /> <br /> WHEREAS, the Cabarrus County Board of Electio~'~v~s' created by the North Carolina <br />General Statute §163-30, and said statute imposes the duties of personnel administration of <br />elections department employees upon the Cabarrus County Board of Elections, and <br /> <br /> WHEREAS, the County of Cabarrus has a Personnel policy which provides for a system <br />of personnel management and administration for the employees of the County, as authorized in <br />North Carolina General Statutes § 153A-92 et. seq., but the application of this policy is automatic <br />only upon~ the County's formal employees, and <br /> <br /> WHEREAS, the Cabarrus County Commissioners and the Cabarrus County Board of <br />Elections are both desirous to provide a comprehensive employment system to the employees of <br />the Board of Elections employees. <br /> <br /> NOW THEREFORE, the County of Cabarms and the Cabarrus County Board of <br />Elections do mutually agree as follows: <br /> <br />1. The County of Cabarrus will, by and through its Human Resources Department, assist the <br /> Elections Director in providing a uniform system of personnel administration for the <br /> employees of the Cabarrus County Board of Elections under the rules, regulations and <br /> procedures applicable to Cabarrus County employees. <br />2. Cabarrus County will administer leave policies, position classification, and compensation and <br /> benefits for employees of the Cabarrus County Board of Elections. <br />3. The Cabarrus County Board of Elections and the Cabarras County Elections Director will <br /> observe Cabarrus County's policies and procedures concerning general employment rules and <br /> regulations and conditions of employment so long as the County's personnel policies do not <br /> conflict with the State's applicable statutes controlling the employment of the Board of <br /> Elections' employees. This agreement does not affect the Cabarrus County Board of <br /> Elections' statutory authority to appoint and remove employees. <br />4. Cabarrus county's policies and procedures concerning disciplinary actions against employees <br /> and employee grievances will govern this aspect of personnel administration; however, any <br /> appeals from employment decisions will be heard and disposed of only by the Cabarrus <br /> County Board of Elections, and there will be no appeal of the decision of that Board to any <br /> County entity. <br />5, This Memorandum of Understanding will be effective when signed by all parties involved.
