124 <br /> <br />DRAFT <br /> <br />County effective June 30, 2001. Also, he advised that NuCare Carolina <br />Aabbulance, Inc. had withdrawn its franchise request. He stated that <br />Specialized Transport and Harrisburg Volunteer Fire and Rescue have applied <br />for a non-emergency a~bulance franchise and have submitted ali required <br />certifications for the issuance of a franchise. According to Mr. Harwood, <br />Specialized Transport has an excellent reputation in surrounding counties and <br />Harrisburg Fire and Rescue has often provided backup support for Cabarrus <br />EMS. He resommended approval of the franchise requests for both organizations <br />to meet the need for non-emergency transports in Cabarrus County. <br /> <br /> Mr. Dean Hastings, owner of Specialized Transport, gave a brief <br />overview of his company that was established si~ years ago. The company <br />specializes in wheelchair, geriatric and convalescent stretcher <br />transportation. <br /> <br /> Assistant Chief Bryan Dunn of the Harrisburg Volunteer Fire and Rescue, <br />Inc., was present to answer any questions regarding that department's <br />franchise request. The Board had no questions for Assistant Chief Dunn. <br /> <br /> At 7:46 p.m., Chairman Fennel Opened the public hearing to consider the <br />requests by Specialized Transport and Harrisburg Volunteer Fire and Rescue, <br />Inc. for non-emergency ambulance franchises. The Public Hearing Notice was <br />published in THE INDEPENDENT TRIBUNE on June 4 and 11, 2001 and in THE <br />CHARLOTTE OBSERVER (Cabarrus Neighbors) on June 7 and 14, 2001. <br /> <br /> There was no one present to address the Board, and Chairman Fennel <br />closed the public hearing. <br /> <br /> U~ON MOTION of Chairman Fennel, seconded by Commissioner Freeman and <br />unanimously carried, the Board adopted on first readinq the following <br />Resolutions and Ordinances granting non-emergency franchises to Specialized <br />Transport and Harrisburg Volunteer Fire Department and Rescue, Inc. <br /> <br />Resolution No. 2001-i2 <br />Ordinance No. 2001-04 <br /> <br /> RESOLUTION AND ORDINANCE <br /> GRANTING A NON-EXCLUSIVE FRANCHISE TO <br /> SPECIALIZED TRANSPORT, <br /> FOR THE OPERATION AND REGULATION OF A <br /> NON-EMERGENCY ~MBUI~/gCE SERVICE <br />WITHIN CABARRUS COUNTY, NORTH C~-ROLINA, <br />PURSUANT TO THE TERMS OF THAT CERTAIN ORDINANCE <br />ADOPTED SEPTEMBER 4, 1990, AND CONSTITUTING <br /> THE FRANCHISE AGREEMENT REFEKRED TO THEREIN <br /> <br /> WHEREAS, on September 4, I990, the Board of Co~mmissioners of Cabarrus <br />County {the "County") adopted an A/~bulance Franchise Ordinance providing for <br />the grant of franchises for the operation and regulation of non-emergency and <br />emergency ambulance service in Cabarrus County, North Carolina (the <br />"Ordinance"); and <br /> <br /> WHEREAS, Specialized Transport, has submitted its "Proposal for <br />Cabarrus County" dated May 13, 2001 (the "Proposal"), to the County to <br />operate a non-emergency ambulance service in Cabarrus County; and <br /> <br /> WHEREAS, the County desires to approve and enter into this Resolution <br />and Ordinance and Franchise Agreement (the "Resolution and Franchise <br />Agreement"], granting a franchise to Specialized Transport. <br /> <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED AND ORDAINED BY THE BOARD OF <br />COMMISSIONERS OF CABARRUS COUNTY, NORTH CAROLINA: <br /> <br /> 1. The County hereby grants the non-exclusive right, privilege, and <br />franchise to Specialized Transport to operate and maintain a non-emergency <br />ambulance service in Cab~rrus County for a period of five (5] years from and <br />after the date of acceptance of this Resolution and Franchise Agreement by <br />Specialized Transport, subject to present and future ordinances pertaining <br />thereto. The County expressly reserves the right to grant other rights, <br />privileges, and franchises to any other person or entity at any time during <br />the term thereof. <br /> <br /> 2.
