ICABARI US COUNTY] <br /> NO~TH CII~O H fl,~ <br /> <br />July 23~a Agenda <br /> <br />MEMORANDUM <br /> <br />TO: Board of Commissioners <br /> <br />DATE: July 16, 2001 <br /> <br />RE: EXPO PROJECT ACTION ITEMS <br /> <br />There are several issues/actions the County Commission will need to address relating to the Expo Project. <br />Pending action(s) of the Board, staffwill act as directed. <br /> <br />I. BID PROTEST - BEERS CONSTRUCTION GROUP <br /> <br />See: July 1 I, 2001 Letter - Moore & Van Allen <br />See: Bid Process Summary Memo - Ms. Para Dubois <br /> <br />Ms. Dubois oversaw the bid opening which was conducted by the project Architect Tim Demmitt. <br />Multi-prime bids were received at 2:00 p.m. but held until 3:00 p.m. Single-prime bids were <br />received at 3:00 p.m. Multi-prime bids were opened first beginning at 3:00 p.m. with single- <br />prime bids opened thereafter. <br /> <br />During the time between 2:00 p.m. - 3:00 p.m., staff was in direct contact with Fletcher Hartsell <br />(Raleigh) and Ms. Frayda Bluestein (I.O.G., Chapel Hill) regarding the circumstances involving <br />the Beers Group bid. Actions taken by staffwere in accordance with the legal opinions provided. <br /> <br />The Beers Group contends their bids (unopened or verified) were the lowest multi-prime general <br />and single-prime contractor bids. The Beers Group bid for single-prime general contractor could <br />not be considered because it was submitted openly, without an envelope. <br /> <br />· The County Commission's options regarding the Beers Group bid protest are: <br /> <br />Ao <br /> <br />Reject all bids. Direct staff (and the Architect) to re-bid. This will create a two +/- week <br />delay and require a called meeting of the Board to award the bid(s). <br /> <br />Reject the Beers Group protest and move forward to award bids. <br /> <br />The Beers Group may have held a low bid; and if so, it is regretful they did not submit it as did <br />other bidders (in a timely manner). State laws do not allow local governments much flexibility in <br />the bidding process. <br /> <br /> Office of the County Manager <br />P.O.
