PURCHASE AGREEMENT <br /> <br />STATE OF NORTH CAROLINA <br /> <br />COUNTY OF CABARRUS <br /> <br />THIS AGREEMENT, entered into this 17th day of August ,2001, <br />by and between the CITY OF KANNAPOLIS, a municipal corporation of the Stale of <br />North Carolina, (hereinafter "City") and Cloninger Ford , <br />(hereinafter "Seller"); <br /> <br />WITNESSETH: <br /> <br /> That whereas, City wishes to purchase from Seller ce~taln tang/ble personal <br />property as described hereinafter and Seller wishes to sell such property to City. <br /> <br /> Now, therefore, in consideration of the premises contaned herein, the part/es <br />agree as follows: <br /> <br /> SECTION ONE <br />DESCRIPTION OF PROPERTY <br /> <br /> Seller agrees to sell the tangible personal property of the description, in the <br />quantities and of the quality indicated on the attached document designated as <br />Attachment "A" which document is incorporated as a part of this agreement. <br /> <br />SECTION TWO <br />PURCHASE PRICE <br /> <br /> The aggregate purchase price for property to be purcha.~ed and sold pursuant to <br />this agreement is as shown on Attachment "A". Provided, however, it is thc agreement <br />of the parties that this represents an approximate aggregate purchase price based upon the <br />estimated number of items to be ordered by City annually. The actual number of each <br />item ordered may vary fi.om that which is indicated on Attaching-ut "A". However, the <br />price per item as iud/cared on Attachment "A' shall remain fixed throughout the term of <br />this contract. <br /> <br />SECTION THREE <br />DELIVERY <br /> <br /> Seller shall deliver the property described above within 90 days following <br />order for item(s) by City. Seller shalI deliver the property so ordered to the Karmapolis <br />City Offices or to such other place within the City of Karmapolis as designated by City <br />Manager.
