Bartlett <br /> Executive <br /> Director <br /> <br />Subject: Useof?unch-Oard¥otingE. quipment <br /> <br />On July 28, 2001, Governor Easley signed into law HB 34, ratified as Session Law 2001- <br />310. The effect of this legislation bans the use of punch-card ballots effective for any <br />referendum, primary or other election conducted after January 1,2006. A copy of the <br />legislation is enclosed. <br /> <br />North Carolina does not use the "butterfly" ballot; however, this legislation immediately <br />bans the use of the butterfly ballot for referenda, primaries or elections conducted after <br />the legislation becomes law. <br /> <br />G.S. 163-161 contains the pr, ocedures for the purchase or lease of voting systems <br />approved by the State Board of Elections. The basic requirements are: <br /> (1) Obtain for review by the county attorney and county financial officer, a <br /> current financial statement from the proposed vendor or lessor <br /> (2) Witness a demonstration of the voting system by the proposed vendor or <br /> lessor and a demonstration of at least one other type of voting system <br /> (3) Test the proposed voting system during a primary or election in at least one <br /> precinct in the county. <br /> <br />We know of no immediate moves from State or Federal sources for distribution of funds <br />to counties for the purchase of voting equipment.
