The proposed subdivision <br />does not meet the adequate public facilities ordinance for school <br />capacity. <br /> <br />Approval of the subdivision is recommended with the following <br />labeling corrections to the plat and an approved consent agreement <br />advancing the adequacy of school capacity with the Cabarrus <br />County Board of Commissioners. Additionally, the recommendation <br />should include a condition regarding water and sewer services. <br />Letters have been made available that state that water and sewer <br />services reach the property, however, there is no guarantee on <br />flows. The condition should state that the developer must be able <br />to obtain approved water and sewer plans and service guarantees <br />prior to any final plats being issued. (l) Label all streets as public <br />rights-of-way. (2) Label open space type and identify the party <br />responsible for maintenance. (3) Addition of a fire hydrant to Gerry <br />Court. <br /> <br />Staff recommends denial based on the adequate public facilities <br />ordinance. Mr. Lentz said it does meet the technical design <br />standards but it does not meet the adequate public facilities <br />ordinance. <br /> <br />Mr. Drye asked why Cabarrus County schools did not make any <br />comments. <br /> <br />Mr. Lentz said the planning staff has taken on the role of gathering <br />this information. <br /> <br />There being no further comments Mr. Hill MOTIONED to approve <br />the design plan for Petition C01-06(S) with the three <br />recommendations from staff, seconded by Mr. Lancaster. <br /> <br />Mr. Dwiggins said to the Vice Chair that this is the second <br />subdivision in a row that the Board has handled this way, in a two- <br />phase manner. He said it appears that both of these subdivisions <br />have the same problem and that is the schools. Mr. Dwiggins said <br />he does not really feel like the Board should consider whether it is <br />technically correct considering that that deficiency exist. <br /> <br /> <br />
