According to Mr. Downs, the company would be available <br />immediately and would complete the job in one week, thus allowing parking in <br />this area while the adjacent parking lot is being prepared. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Privette <br />with Commissioners Barnhart, Privette and Casper and Chairman Fennel voting for <br />and Commissioner Carpenter voting against, the Board awarded the contract for <br />the demolition and removal of the vacated school building at 70 Corban Avenue <br />to Propst Construction Company, Inc. in the amount of $33,795.32 as recommended <br />by Mr. Downs. <br /> <br />Appointment of Jonathan Marshall as Special Conmmi$~ioner for Activities <br />Involved with the Re-Survey of Cabarrus County Boundaries with Rowan, <br /> <br />Mecklenburq and Union Counties <br /> <br /> Mr. Jonathan Marshall, Planning Services Director, reviewed plans by the <br />North Carolina Geodetic Survey office to resurvey the county boundaries between <br />Cabarrus County and the counties of Rowan, Mecklenburg and Union. The new <br />survey will help to locate historical markers and clear up any discrepancies in <br />the county boundaries. <br /> <br /> Commissioner Barnhart introduced discussion regarding the previously <br />approved realignment of the Cabarrus/Iredell boundary. The Board had agreed at <br />the time of approval that any existing school assignments would be given a <br />"grandfathered" status if impacted by the county boundary change. However, <br />Commissioner Barnhart advised that school attendance areas have not yet been <br />permanently resolved by the school boards in the two counties. <br /> <br /> After discussion, Board members generally agreed that the school <br />attendance area issue with Iredell County should be resolved but should not <br />delay the State's work in ~urveying the other county boundaries. If not <br />resolved, the Iredell County issue will be brought back to the Board for <br />further discussion at a later date. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Casper <br />and unanimously carried, the Board appointed Jonathan Marshall as the Special <br />Commissioner for Cabarrus County to participate in activities involved in the <br />review of the survey of the Cabarrus County boundaries with the counties of <br />Rowan, Mecklenburg and Union per North Carolina General Statute 153A-ISa. <br /> <br />NEW BUSINESS <br /> <br />An Ordinance to Provide for the Control of Soil Erosion and Sedimentation, <br />First Amendment and Restatement - Public N~arlnq - 8:30 p.m. <br /> <br /> Mr. Tony Johnson, Erosion Control Specialist, briefly reviewed the <br />revised "Ordinance to Provide for the Control of Soil Erosion and <br />Sedimentation." He requested an effective date of October 1, 1999 to correspond <br />with changes in North Carolina State Law. Further, Mr. Johnson presented an <br />additional change to add the words "Concord, Mt. Pleasant and Harrisburg" to <br />the first paragraph of Section 3, Jurisdiction. <br /> <br /> Chairman Fennel opened the public hearing at 8:00 p.m. concerning the <br />revised Ordinance and asked if anyone wished to speak regarding the proposed <br />revisions. The Notice of the Public Hearing was published in THE INDEPENDENT <br />TRIBUNE on December 3, 1999 and in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) <br />on December 5, 1999. <br /> <br /> There was no one present to address the Board, and Chairman Fennel closed <br />The public hearing. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted Ordinance Number 1999-09, "An Ordinance <br />to Provide for the Control of Soil Erosion and Sedimentation, First Amendment <br />and Restatement," as presented and authorized the amendment of Chapter 57 of <br />the Cabarrus County Code of Ordinances to include the Revised Ordinance.
