ITEM 2. Term. This agreement shall continue in force beginning January 1, 2000 - December 31, 2000 ("Initial Term"). The County, at its sole option, may extend this Contract for an additional two-year term by giving written notice to the Contractor at least sixty days prior to the expiration of the Initial Term. ITEM 3. Nonappropriation Contractor understands and is in total agreement with the principal that funds for payment by the County under this Contract are subject to the availability of an annual appropriation for this purpose by the County Board of Commissioners. In the event of nonappropriation of funds by the County for the Services, the County may terminate this Contract, without termination charge or other liability, on the earlier to occur of: (1) the last day of the then-current fiscal year; or (2) when the appropriation made for the then-current year for Services covered by this Contract is spent. Notwithstanding any other re, al or condition of this Contract or any other agreement by and between the parties hereto, if at any time funds are not appropriated for the continuance of this Contract, the County will use reasonable efforts to provide the Contractor with thirty days' prior written notice of termination; however, failure to give such notice shall be of no adverse effect or consequence to the County and the County shall not be obligated under this Contract beyond the date of non-appropriation. ITEM 4. Termination. (a) Upon the occurrence of any one or more Contractor violations of this Contract (including without limitation, failure to perform in accordance with the Specifications) this Contract may be subject to cancellation by the County, at the County's sole option.
