and all agreements entered into by Tenant and Landlord with regard to the Demised <br /> including insurance policies; including, without limitation, Legal Requirements which <br />require unforeseen or structural alterations or repairs to the Demised Premises. <br /> <br /> 5. Si~,ns. Tenant, at its cost, and subject to Landlord's written approval, may erect <br />and shall thereafter maintain and repair in good order, condition and repair: such signs upon the <br />exterior walls of the building on the Demised Premises as it desires, provided the installation <br />of such signs shall not affect or damage the roof of the building on the Demised Premises; and <br />(b) Tenant's identification panel on the pylon or monument sign currently located in the <br />Shopping Center, if any. Tenant shall, at its cost, obtalrl all approvals necessary for such signs, <br />pylon and panel and shall otherwise comply with all Legal Requirements applicable thereto. <br /> <br /> 6. Common Areas. "Common Areas" shall mean the sidewalks, service drives, <br />parking aisles, driveways and parking areas which shall exist from time to time on the Shopping <br />Center, except those areas which shall be occupied fromtime to time by buildings or structures <br />or which shall be designed for the exclusive use of landlord or the other owners, tenants and <br />subtenants of the Shopping Center, and their respective agents, employees, customers, licensees <br />and invitees. Tenant's use of the Common Areas shall be subject to such rules and regulations <br />of l~ndlord as may be reasonably promulgated from time to time. Tenant may not use the <br />Common Areas for sales, shows or other events or for any purpose other than ingress, egress <br />and parking. <br /> <br /> 7. Maintenance. Landlord shall maintain and repair the roof and structural portions <br />of the Demised Premises; and Landlord shall be .responsible for substantial resurfacing work <br />required in Tract A of the Common Areas as shown on Exhibit B, except as provided in Section <br />8(a). Except as expressly provided as Landlord's obligation in the preceding sentence and as set <br />forth elsewhere in this Lease, Tenant shall, at its own expense, replace all plate glass as <br />necessary and make all other repairs, maintenance and replacements to the Demised Premises, <br />exterior and interior, and to Tract A of the Common Areas, foreseen and unforeseen, as shall <br />be necessary to keep the Demised Premises and Tract A clean and in good order, condition and <br />repair, including, without limitation, (i) maintaining, repairing and replacing the utility lines and <br />service; (ii) maintaining the landscaped areas; and (iii) sweeping, cleaning and removing snow <br />and ice. During the Lease Term, Tenant shall have regular servicing and maintenance (at least <br />once quarterly) of the heating, ventilating and air conditioning systems serving the Demised <br />Premises. Except as expressly provided as Landlord's obligation in this Section 7 and elsewhere <br />in this Lease, Landlord shall not be required to maintain, repair or rebuild the Demised Premises <br />and Tenant waives the right to perform maintenance or make repairs at the expense of I.andlord <br />pursuant to any law at any time in effect. <br /> <br />8. Alterations. <br /> <br /> (a) Prior to commencing any alteration, Tenant shall deliver to Landlord a <br />complete copy of plans and specifications for the proposed alteration, together with a copy of <br />all building and other governmental permits required for such alteration (including, without <br /> <br />~t291046,03 11126196 <br /> <br /> <br />
