418 <br /> <br /> Mr. Hartsell reviewed the Board's Rules of Procedure relative <br />approval, denial and/or reconsideration of the issue at the next meeting. <br /> <br />to <br /> <br /> Commissioner Privette made a motion, seconded by Chairman Fennel to <br />approve Petition C00-02(R) with the conditions of the site plan, a cap of <br />1,670 residential units and the transportation improvements that were <br />recommended as part of ~he traffic study. The Findings of Fact were as <br />follows: (1) Developer has agreed to make the recommended transportation <br />improvements; {2) Developer has agreed to the limit on density; and (3) <br />Developer will be providing school sites to address school adequacy issues. <br />The motion failed with Commissioner Privette voting for and Chairman Fennel <br />and Commissioners Barnhart and Carpenter voting against. <br /> <br /> Chairman Fennel stated that he would make a motion at the April meetin9 <br />to reconsider Petition C00-02(R). <br /> <br />Resolution ADnrovin= the Exchange of Real Property (Odell School ~rac~ for a <br />61-Acre Tract) <br /> <br /> At the meeting on February 21, 2000, the Board authorized publication <br />of a "Notice of Exchange of Real Property" for the exchange Of the Odell <br />School property for approximately 62 acres of real property owned by J & B <br />Management and Development, rough graded at a value of at least an additional <br />$300,000.00 and a cash contribution of $350,000.00 to address school adequacy <br />issues. The Board was scheduled to approve the Resolution authorizing this <br />exchange at the March 20~h meeting. <br /> <br /> Mr. Clifton reported that the architect is working on the design for a <br />middle school at this site. He asked for direction as to how to proceed with <br />this work and suggested the Board may wish to authorize the County Attorney <br />to proceed with filing a notice for the condemnation of the 62+/- acres. <br /> <br /> There was discussion regarding the tract of property, its suitability <br />for a school site and fill regulations for flood plains. Mr. Clifton <br />confirmed that the property is suitable as a school site and stated a number <br />of core borings have been completed on the property. He stated that the <br />County Schools had identified the property as a school site. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board authorized the County Attorney to issue a <br />Notice of Action to institute condemnation proceedings to acquire 62 +/- <br />acres of property owned by J & B Management and Development and identified at <br />a value consistent with the tax value for the property. The purpose for <br />which the property is to be condemned is to expand and enhance the facilities <br />available for the education of children of Cabarrus County, and for the <br />recreation of the public, specifically for a new school and/or park facility. <br /> <br /> Consideration of the proposed exchange was deferred until the next <br />meeting. <br /> <br />Cable Television Rate Review Findinus and Frannhis~ Revigw - MS- Sandra <br />Montgomery, Centrelina Council of Governments <br /> <br /> Ms. Sandra Montgomery, AICP, Cable Telecommunications Administrator <br />with the Centralina Council of Governments, reviewed the Cable Television <br />Rate Review Findings Summary for Time Warner - Metrolina for both the Basic <br />Tier for 2000 and the Equipment and Installation Rates for 2000. The Social <br />Contract, which controlled Time Warner's rates for the past five years, has <br />expired. Also, this is the first year that Time Warner is allowed to set <br />equipment rates that can be reviewed by the local franchise authority and <br />approved. <br /> <br /> There was brief discussion regarding the rate schedule and the <br />different tiers of programming service. MS. Montgomery and Mr. Robert <br />Melton, General Manager of Time Warner - Metrolina, responded to questions <br />about the difference in the "basic" rate and the "standard" package that is <br />purchased by most customers. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Barnhart <br />and unanimously carried, the Board approved the following action: (1) <br />Approved the Cabarrus County basic cable rate at $6.37 per month per <br />subscriber for the year 2000 and 2001; (2) Approved the Cabarrus County <br />equipment and installation rates as shown in the Findings Report for the year <br />2000; and (3) Adopted a ~Resolution Providing for the Change in Control of a <br />Cable Television" relative to the merger of Time Warner, Inc. and America <br />Online, Inc. <br /> <br /> <br />
