building shall be damaged to such an extent as to render the same unfit for use or occUpancy, this <br />Lease shall terminate and the proceeds of insurance coverage shall be paid to Cabarrus County, <br />and Historic Cabarms shall be relieved from further liability under the Lease. <br /> <br /> 5. Historic Cabarrus shall be responsible for the payment of all bills for water, heating <br />and electrical current, and the occupants of the building shall be responsible for the payment of <br />their own respective telephone bills. <br /> <br /> 6. Historic Cabarms shall not have the right to assign this Le~se without prior approval <br />by the County but shall have the right to sublet any parts of the Historic Cabarms County <br />Courthouse to such organizations as it may desire subject to the terms of this Lease; provided, <br />however, that Historic Cabarrus and its tenants shall make no unlawful or offensive use of the <br />premises. Historic Cabarrus hereby warrants that it will not arbitrarily restrict the use of said <br />premises and, subject to its use of the building and the agreements Historic Cabarms enters into <br />with any sub-lessee, will make the building available for bona fide public uses. <br /> <br /> 7. If Historic Cabarrus shall not be diligent in its solicitation of funds and shall fail to <br />pursue its work in the maintenance and preservation of the Historic Cabarms County Courthouse <br />in an orderly manner for a period of ninety (90) days after written notice of such default by the <br />County or shall violate any other terms of this lease, the County shall have the right to its option <br />to declare this Lease canceled. <br /> <br /> 8. It is understood by the County that the funds for the preservation and renovation of <br />the Historic Cabarms County Courthouse will necessarily be supplied by contributions from <br />individuals, firms, corporations, foundations and other agencies; that the acquisition of such <br />funds may not be constant but will be affected by prior commitments of the respective <br /> <br /> <br />
