DRAFT <br /> <br />Planning and Zoning Commission Minutes <br />May 18, 2000 <br /> <br />DRAFT <br /> <br />Page 23 <br /> <br />The Chair introduced the fifth item on the Agenda, Zoning Atlas Amendment, <br />Petition C00-06(R): <br /> <br />Applicant: David Bigford <br />Request: Zoning Atlas Amendment <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from David Bigford Enterprises, :[nc., Petition C00-06(R) to have his property <br />rezoned from Low Density Residential/ Limited Commercial to Limited <br />Commercial - Special Use. The purpose is to change existing zoning for the <br />purpose of developing multi-family housing as well as related commercial uses <br />along NC 24-27. <br /> <br />The Chair swore in Mr..]erry Newton, Mr. David Bigford, Ms. Brenda Farmer <br />Beechman and Mr. Michael Byrd. <br /> <br />Mr. Michael L. Byrd, Transportation Planner, addressed the Board presenting <br />Petition C00-06(R) and staff report stating there are two different tracts involved <br />in this rezoning. One is approximately I 1/2 acres the other one is approximately <br />71/4 acres. They are proposing some type of commercial along the front and <br />multi-family use, when utilities are available, in the rear. He said the developer <br />is willing to place with the special use addition to the rezoning, a limitation on <br />the uses that could be allowed with this rezoning. Mr. Byrd said the developer <br />cannot develop this multi-family currently because they do not have the utilities <br />to do it. Right now it is zoned so you can put one-acre houses on the lots. They <br />are requesting rezoning for future use when sewer is available in the area. <br /> <br />Mr. Jerry Newton, representing the property owners, addressed the Board <br />stating Bigford Enterprises does own the property in front and they have an <br />option on the property in the back. He said the developers are attempting to <br />take out more than half the uses that are currently allowed in the front portion to <br />be able to better blend what is occurring in that area. He said the entire length <br />of Highway 24/27 from Mecklenburg County is stripped with the Limited <br />Commercial zoning district, which currently allows eight dwelling units per acre. <br />Mr. Newton said this request they see as very timely in terms of being able to <br />implement part of what the area plan calls for. The area plan calls for <br />concentrated node of commercial development and appropriate residential <br />development to bridge Iow density. That was done in 1997. it identifies this <br />parcel and that general area around the intersection to have this type of use. He <br />said the application is very specific. No apartments will be permitted in the first <br /> <br /> <br />
