Planning and Zoning Commission Minutes <br />May 18, 2000 <br /> <br />DRAFT <br /> <br />Page 20 <br /> <br />Mr. Yates thanked the Board for their time tonight. He said their goal tonight <br />was to address the ordinance as it relates to the whole county. Mr. Yates said <br />there are no special parts of the county this is a county as a whole. The <br />government place regulations that apply countywide in the various zoning <br />districts. He said the best evidence of all is that out of seven proposed sites in <br />Cabarrus County this year four have been taken of with co-location. Mr. Yates <br />said they strongly feel that they have meet all of the requirements for this <br />application. <br /> <br />Mr. Lowe said to the Chair that there is someone in the audience tonight that <br />wishes for someone to address the question about a Duke Power tower <br />somewhere in that vicinity. The person wants to know why that tower cannot be <br />used. <br /> <br />Mr. Butler said to address that, some people asked why 300-feet. He said <br />through the FAA they~i'ave required~'them to put that height at 200-feet. Hr. <br />Butler said the height of the Duke Power tower and the others were just not <br />acceptable for the co-location that they ~vanted. <br /> <br />There being no further comments Mr. Drye MO-I'~ONED to approve Conditional <br />Use Application 250(C) based on the testimony given and a bond be proved for <br />removal of tower if it is abandoned, seconded by Mr. Dwiggins. <br /> <br />The Chair said the tower is a permitted use under the zoning ordinance. This <br />hearing is for the Board to determine that it complies with the standards and <br />requirements of the ordinance. The Chair said they find that it does and the <br />applicant have demonstrated a need and they also have met the condition that it <br />has co-locatable ability. <br /> <br />The vote was unanimous. <br />Conditional Use Application 250(C) Approved. <br /> <br />The Chair introduced the fourth item on the Agenda, Preliminary Subdivision Plat <br />Approval, Petition C00-02(S): <br /> <br />Applicant: Hark & Dakeita Horton <br />Request: Preliminary Subdivision Plat Approval <br /> <br /> <br />
