Planning and Zoning Commission Minutes <br />May 18, 2000 <br /> <br />DRAFT <br /> <br />Page 2! <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mark & Dakeita Horton to have their subdivision Vanderburg Estates, Phase <br />]~], plat approved preliminary. <br /> <br />Mr. Michael L. Byrd, Transportation Planner, addressed the Board presenting <br />Vanderburg Estates, Phase II: subdivision, stating the staff analysis <br />recommended placing a turn lane on Highway 601. After looking at the number <br />of lots in the older portion of Vanderburg Estates, staff would like to remove the <br />recommendation for a turn lane on Highway 601. Mr. Byrd said NCDOT is <br />satisfied with is out there now. Mr. Byrd said he received a letter from the <br />developer requesting, if the Board would limit them to only issuing l0 building <br />permits per year in the subdivision, that they not be required to comply with the <br />adequate facilities ordinance. He said that leaves the Board an option. They <br />could either limit it to :L0 lots per year or do as they have been doing with <br />subdivisions or made a recommendation that the decision be made by the <br />County Commissioners~'Mr. Byrd said the staff is comfortable with the limitation <br />with the 10 building permits per year. <br /> <br />The Chair said the Board did not have a study school capacity in the outer years. <br />He asked when would Rocky River School be built. <br /> <br />Mr. Byrd said he is not sure. <br /> <br />Mr. Koch said as a point of clarification it cannot be released from the ordinance. <br />The Board would have to determine that you would only approve it for no more <br />than :LO lots a year that they will meet the ordinance. He said they can not get a <br />waiver by saying that they will only develop l0 lots a year. They will have to <br />comply with the ordinance. <br /> <br />The Chair said the Board does not have information to the fact that no matter <br />how many they build, that the schools will be adequate. <br /> <br />Mr. Galliard Mervin addressed the Board stating he is working with Mark and <br />Dakeita Vanderburg in this proposed subdivision. He said in meeting with <br />Jonathan Marshall a few days ago they discussed the school situation. He said <br />Bethel Elementary, _I.N. Fries Middle and Central Cabarrus High schools would <br />serve this particular subdivision. Mr. Mervin said, as he understands the <br />adequate facilities ordinance, if schools have been planned and/or funded, that is <br />where the break-off comes. He said Jonathan indicated to him with plans for the <br />new Bethel Elementary school and the new high schools, the problem will not <br /> <br /> <br />
