×/ <br /> <br />AGREEMENT TO <br />MODIFY AND AMEND <br />LEASE AGREEMENT <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br /> TI-H~q AGREEMENT TO MODIFY AND AMEND LEASE <br />AGREEMENT, is made and entered into this day of June, 2000, by <br />and between the COUNTY OF CABARRUS (hereafter, "County") and the <br />CHURCH OF GOD CHILDREN'S HOME OF NORTH CAROLINA <br />(hereafter, "Children's Home"), <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, on or about February 15, 1999, the County and the <br />Children's Home entered into a Lease Agreement, a copy of which is <br />attached hereto as Exhibit A and incorporated as if more fully set forth <br />herein (hereafter, the "Lease") providing (among other things) for the lease <br />of certain property from the Children's Home to the County for purposes of <br />a public park (the "Park"); and <br /> <br /> WHEREAS, the County and the Children's Home have agreed to <br />certain modifications and amendments to "Exhibit A" to the Lease, in order <br />to accommodate a redesigned entrance to the Park and the addition of a stop <br />light at the intersection of Orphanage Road, Oakwood Avenue and the <br />proposed new entrance to the Park (hereafter, the "Intersection"); and <br /> <br /> WHEREAS, Children's Home owns ail four comer plots of land at <br />the Intersection, as the Intersection is shown on Exhibit "B' attached hereto; <br />and <br /> <br /> WHEREAS, in order to provide for: (1) acceleration and deceleration <br />lanes approaching the proposed Park entrance and the Intersection; (2) <br />construction and installation of the stoplight; and (3) the construction of the <br />newly designed and relocated entrance mad to the Park; all of which <br />improvements are shown on Exhibit B hereto (the "Improvements") <br />Children's Home must provide an easement or right-of-way onto additional <br />pieces of its property and/or lease additional property to the County for these <br />purposes. <br /> <br /> NOW, THEREFORE, in consideration of the premises and o~her <br />good and valuable consideration, acknowledged by the parties hereto to be <br />sufficient, the parties agree as follows: <br /> <br /> 1. The parties hereto agree that upon final discussions with the North <br /> Carolina Department of Transportation ("NCDOT") to resolve final details <br /> regarding construction and maintenance of some or all of the Improvements, <br />· Exhibit "A" to the Lease will be modified and amended by the parties to <br /> <br /> <br />
