COPY <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this let day of <br />Septembe= ,1998, by and between CITY OF CONCORD , a municipal <br />corporation of the State of North Carolina, hereinafter referred to as "CITY" and <br />'CABARRUS COUNTY", a governmental subdivision of the State of North Carolina, <br />hereinafter referred to as 'COUNTY'; <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the CITY and COUNTY each operate public library systems, which <br />through a long-term contractual agreement, have functioned essentially as a joint <br />system to provide public library service to all residents of Cabarrus County; it is agreed <br />upon by the CITY AND COUNTY that it is in the best interests of their constituents that <br />the respective library departments shall be consolidated into a single public library <br />department. Therefore, it is agreed that the Library Department of the CITY will be <br />transferred to the COUNTY and shall be operated as a component of the COUNTY <br />library system. IT Is recognized that the purpose of this consolidation is to create a <br />structure for the economical delivery of public library service of the highest quality of all <br />residents of Cabarrus County. This consolidation will create a more efficient operation, <br />provide an effective framework for planned growth of the public library system, provide a <br />single track for the implementation and management of library technology, provide an <br />environment for efficient personnel'management and provide a measure of tax fairness <br />for taxpayers of the City of Concord. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the mutual <br />agreements hereinafter made, the parties do agree as follows: <br /> <br /> 1. There will always be a public library facility located in the historic business <br /> district of the City of Concord. <br /> <br /> 2. The name Charles A. Cannon Memorial Library will remain on the library <br /> facility unless added to or changed with the concurrence of the Concord <br /> City Council. <br /> <br /> 3. The COUNTY appoints an advisory board known as the Library Board of <br /> Trustees, which will have two seats designated for citizens living within the <br /> geographic boundaries of the City of Concord. One of these seats would <br /> be appointed by the Concord 'City Council and the appointment for the <br /> second seat would have the concurrence of the Council. <br /> <br /> 4. The CITY will sell the Library ~cllity including the parking lot, the property <br /> upon which It is located and the contents of the facility, including furniture, <br /> computer equipment, Dynix software license and library materials to the <br /> COUNTY for the price of $1.00. As owner of the facility, the COUNTY will <br /> be responsible for maintenance of the buildings and grounds. The Library <br /> vehicle, a 1992 Ford Taurus stolon wagon, will also be included in this <br /> property transfer. The only condition placed upon this properb/transfer is <br /> that should the building ever be abandoned as a library, it will be sold at <br /> fair market value and the proceeds of this sale will be used for the <br /> <br />1 <br /> <br /> <br />
