532 <br /> <br /> Ordinance No. 2000-03 <br />PETITION C00-01(ST) <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> SUBDIVISION REGULATIONS <br /> <br />BE IT ORDAINED that the Cabarrus County Subdivision Regulations is hereby <br />amendsd as follows= <br /> <br />Section 66-40. Final plat requirements. <br /> <br />B.12. Location of Floodplain/River-Stream Buffer Overlay - subdivider shall <br />show location of one hundred (100) year flood elevation and location of <br />buffer strip as required by the Eiver/S=ream Overlay. Bonds, Clerk to the Board <br /> <br />CABARRUS COUNT~CODR OF ORDINANCRS <br />Chapter 66, Subdivision Regulations <br /> <br />~nified Development ordinance - ~lie Hearing - $~30 p.m. <br /> <br /> Chairman Fennel recognized Mr. Jonathan Marshall, Planning'Services <br />Director, to make introductory comments concerning the proposed Unified <br />Development Ordinance (UDO). <br /> <br /> Mr. Marshall presented an overview of the proposed UP0 and outlined the <br />process that began in 1997 by the County and the local municipalities to <br />develop the proposed ordinance. Mr. Marshall explained the purpose of the UDO <br />is to unify all land development ordinances among the jurisdictions. <br />However, he pointed out Chat the UDO would continue to he administered and <br />reviewed individually by each of the Jurisdictions. Also, Mr. Marshall <br />stated the existing zoning classification for all parcels would be changed to <br />the most similar category under the UDO. Finally, he advised that staff <br />would prepare a document that specifically references Cabarrus County and <br />related General Statute citations. The model draft was prepared using the <br />City of Concord as a model. <br /> <br /> Chairman Fennel announced those persons with questions about the <br />current and proposed zoning classifications for their property should contact <br />the Planning Services Department. Those persons owning property within the <br />city limits of Concord or Kannapolis should call the planning department for <br />the municipality in which their property is located. <br /> <br /> Mr. Marshall responded to a number of questions by Board members <br />regarding recent changes to the draft UDO, the changes in zoning <br />classifications, the public hearing process and the process for future <br />amendments to the UDO and Zoning Maps. Also, at the Board's request, he <br />addressed a number of items listed in an advertisement published in the local <br />newspapers on September 17, 2000. ~ness included issues related to the <br />following: non-conforming uses; sexually oriented businesses, including <br />supplemental regulations, related constitutional rulings and court cases; <br />dwelling ._units on agriculturally zoned land; the process for splitting off <br />building lots; home businesses and the uss of detached buildings; animal <br />units; the cutting of trees; bona fide farms; the use of cul de sacs and <br />connectivity requirements; conditional uses; and landscaping requirements. <br /> <br /> At 7:36 p.m., Chairman Fennel opened the public hearing concerning the <br />proposed b-DO and Zoning Maps. The Notice of the Public Hearing for the UDO <br />and Zoning maps was published in THE INDEPENDENT TRIBUNE and THE CHARLOTTR <br />OBSERVER (Cabarrus Neighbors) on August 27, September 3, September 10 and <br />September 17, 2000. In addition to those advertisements, Mr. Marshall stated <br />that mailings were sent on September 6, 2000 to those property owners who <br />live outside the circulation area for the newspapers. <br /> <br /> Mr. John Morro, resident of 254 Central Heights Drive, Concord, asked <br />the Board to postpone the final vote on the UDO until after further review. <br /> <br /> <br />
