4. 3.2.4.4.1 refers to needing a plot plan for review to secure a zoning clearance permit. It is not defined <br /> and lef~ to the full discretion of the admlni~ator. <br /> <br />Yes, this needs to be defined in Appendix B. <br /> <br />3.2.4.6 - Six months can be too short of a time period between zoning clearance permit and building <br />permit. Thcrc are many state and sometimes federal permits that are also required as well as financing <br />and contractual issues that make this short. <br /> <br />The UDO is carrying forward the current policy in Cabarrus County. <br /> <br />3.2.5.2.6 - Performance Guarantee should be able to have partial releases. These bonds and letters of <br />credit have significant costs associated with them and should be able to be lowered in relation to the <br />improvements being made. <br /> <br />County staff agrees that this is a good approach. Other jurisdictions feel that partial <br />releases are not appropriate. This is a policy decision that should be made by the Board of <br />Commissioners. <br /> <br />7. 3.2.7.1 - Grading permit - if the grade is not being altered and the vegetation in not fully being <br /> removed why require? <br /> <br />If you are not doing any grading or vegetation removal or are disturbing less than one acre, <br />no permit is required. If you are removing vegetation and doing grading on more than an <br />acre a permit is required and a plan must be submitted showing the limits of the disturbed <br />area. <br /> <br />8. 3.2,7.2 - How is a grading permit different than a sedimentation and erosion control permit. <br /> <br />Our sedimentation and Erosion Control program only evaluates plans for conformance to <br />soil and erosion control standards. This permit allows planning and zoning staffto evaluate <br />the planned grading and its conformance to other standards in the UDO. In many cases the <br />same plan submitted for Erosion Control can be submitted for the Grading permit. <br /> <br />3.2.7.3 - Is a grading permit what is issued after approval of a "grading and conservation plan" <br />identified in B-137 If so, this also deals with vistas. <br /> <br />Yes <br /> <br />10. 3.2.7.6 - How and who interprets "designed to preserve existing trees and vegetation to the greatest <br /> extent possible and shall seek to incorporate existing significant stands of trees as well as individual <br /> trees"? According to Appendix A "Shall" is mandatory, therefore the how and who is very important. <br /> <br /> · The word ".~liall" should be changed to "should" per recommendations of staff technical <br /> committee. <br /> <br /> <br />
