PLANNING STAFF REPORT TO <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br />Tuesday, January 19, 1999 <br /> <br />Staff Usc Only: <br /> ADproved: <br /> <br /> Denied: <br /> Tabled: <br /> <br />Conclusions: <br /> <br />Bryan Properties is appealing the decision of the Planning and Zoning <br />Commission and has submitted this preliminary plat for approval by the <br />Cabarrus County Board of Commissioners. <br /> <br />The subdivision is residential in nature. It consists of 854 proposed units. <br />Each unit will have access to water provided by the Charlotte-Mecklenburg <br />Utility Department (CMUD) and sewer wastewater service provided by the <br />City of Concord. <br /> <br />At build-out, this subdivision may add approximately 512 children to the <br />Cabarrus County school system (See Exhibits 2 and 3). <br /> <br />Please see Exhibit 5 showing the number of unplatted lots in. the W.R. <br />Odell, Northwest Cabarrus Middle, and Northwest Cabarrus High districts. <br />Unplatted lots are lots that have been given preliminary plat approval, but <br />have not been recorded. The point of this map is that there are many lots in <br />the same school districts as the Wallace Farm Property that have already <br />been given preliminary plat approval and will impact school capacity in the <br />near future. <br /> <br />The Board of Commissioners and Highland Creek reached a settlement (See <br />Exhibit 6) where the latter deposited $400,000 in an escrow fund to be <br />allocated towards purchasing a school site in return for subdivision <br />approval. <br /> <br />Staff Recommendation: <br /> <br />It is the recommendation of planning staff that the preliminary plat for the <br />Wallace Farm Property subdivision be DENIED until such time that school <br />facilities are adequate to serve the expected number of students generated by <br />this proposed development. <br /> <br />This recommendation is based on the fact the school system cannot <br />adequately handle the additional students generated by this proposed <br />development (See Exhibits 2, 3, and 4 pertaining to the school district's <br />comments and school enrollment/capacity chart). <br /> <br />PZC Action: <br /> <br />On Thursday, December 17, 1998, the Cabarrus County Planning and <br />Zoning Commission VOTED 8-0 TO DENY the preliminary plat for the <br />Wallace Farm Property subdivision at this time because the proposed <br />development does not meet the adequate public facilities provision of the <br />Cabarms County Subdivision Ordinance (Section 66-81). Specifically, the <br />Cabarrus County School District does not have adequate facilities at this <br />time to serve the estimated number of students who would be generated by <br />the proposed development. <br /> <br /> Page 4 of 4 <br />Wallace Farm Property Preliminary Plat <br /> <br /> <br />
