A RESOLUTION REQUESTING LEGISLATION TO CKANGE THE RATIO OF SALES TAX DISTRIBUTION IN THE STATE OF NORTH CAROLINA WHEREAS, Cabarrus County is experiencing growth in both citizen and school population and has a need for more new school construction; and WHEREAS, the state of North Carolina is experiencing tremendous growth in revenues from all sources; and WHEREAS, the good citizens of Cabarrus County overwhelmingly defeated an attempt to raise the sales taxes an additional 1% to 7% and the highest in North Carolina to pay for school construction needs. Thereby confirming that working families and senior citizens can afford no more new taxes; and WHEREAS the overwhelming majority of citizens in Cabarrus County do not support a resolution endorsing legislation to "reduce debt for public school facilities" by increasing sales taxes above all others in North Carolina; and THEREFORE, BE IT RESOLVED by the Cabarrus County Commissioners that the Legislature be requested to enact legislation that would: . Reallocate the current 6% sales taxes to a system called "Sales Tax 3-2-1." This would be allocated as follows: 3% to the state for the purposes deemed appropriate by our elected congressmen, 2% to the counties. 1% distributed based on population in the county and the second 1% distributed to the county in which the sales occurred, 1% to the cities based on population in the cities and unincorporated portions of the counties. BE IT FURTHER RESOLVED that a copy of this resolution be sent to all county and city governments in North Carolina and be forwarded to the NCACC for inclusion in the 1999 Legislative Goals agenda. There was discussion about the proposal, including its submission as a legislative goal and the need for an analysis of the proposed action and its ramifications. UPON MOTION of Commissioner Carpenter, seconded by Commissioner Fennel and unanimously carried, the Board agreed to put forth Commissioner Fennel's proposal to request legislation to change the ratio of sales tax distribution in the State to a system called ~'Sales Tax 3-2-1" as a recommended legislative goal from Cabarrus County and to send a copy of the proposal to the Chair of all boards of county commissioners in the state for review prior to the Association of County Commissioners Legislative Goals Conference. Commissioner Carpenter proposed legislation relating to an increase in the homestead exemption for the elderly, There were varying opinions on the amount of increase in the exemption, whether the exemption should be a fixed or variable amount, the criteria an individual must meet to qualify for the exemption and the implementation of a statewlde standard versus a local option. After discussion, Chairman Barnhart asked Commissioner Casper to work with Mr. Hartsell and send a copy of the legislation that was considered during the past legislative session to the Board for review and possible approval as a legislative goal. If Board members agree to the proposed legislation, the Board will consider approval of the requested legislation nunc pro tunc at its January meeting. The Board discussed the proposed legislation relating to municipal annexation and i~corporation. Chairman Barnhart suggested the need for legislation to regulate annexation across county lines without prior notice. There were varying opinions concerning annexation issues, and the Board took no formal action regarding the proposed annexation legislation. (c) Designation of Votln~ Delegate UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter and unanimously carried, th? Board designated Commissioner Privette as its voting delegate to the North Carolina Association of County Commissioners Legislative Goals Conference on January 14-15, 1999. Further, the Board designated Commissioner Casper as the alternate voting delegate.
